I think in this case it is much different than producing a weapon while concealing somewhere else (off your property or place of living). You can just ask him to leave verbally from your land, and he has to comply. I think racking a shotgun is the universal language for "get off my property" and I can't see how it leaves much to the imagination. At the same time, you are in your own home, on your own property and can pretty much do whatever you want with your firearms without discharging them. You have just about any excuse if "scaring someone with a firearm" is not legal on your own land...which I would doubt anyway in Texas.

There are other thread(s) which would appear to contradict this belief available on this forum. I personally would tend to agree with your sentiment, but it is the eye of the beholder that really counts (the LEO, the DA, the Judge and the jury).

A guy taps on the back sliding glass window of your house and gets scared because you're cleaning your guns? Which may involve working the action of a shotgun.... :) My point is it would be hard for him to really have much of an argument.

Personally I wouldn't always resort to armed confrontation until the person has shown himself to not want to leave. I just don't like escalation to be done by myself...that said, I don't think he has a right to be on your property if you gave him notice by sign or verbally. My "shotgun notice" was a bit of a joke legally, but practically I think it's true.

Then again perhaps, all your guest sees is you "cleaning" your loaded shot gun and he yells gun and makes a .9 draw from concealment and puts 2 in your head.

You're saying a guy sneaks up on the back door of your house, you pull a shotgun, chamber a shell....and he draws and fires at beyond champion speeds from concealment before you take him out? Would definitely like to not meet that homeless man.

But I'm more afraid of a clown breaking into my house silently and smothering me with a pillow while I sleep after he hid all my guns at my bedside. More likely, and more scary....or maybe I'm just paranoid?

So this guy knocks on your door and you respond by holding a gun to your window? .............. WOW!!! Then after being so terrified by the simple presence of this gankly, worn out, beat down, street person you threatened him with a deadly weapon? Maybe I missed something. What did he do to present himself as a threat in need of deadly force?

One more thing I will add. If this guy turned out to be a real bad guy, he would have simply needed to aim about six to eight inches over and put a couple rounds in your torso. Maybe even blow your hand off. Guess your lucky he was just some guy who maybe was lost and knocked on the wrong door. Strategically, your dead if that was a real menace to society.

Well you did what you did and I guess you felt that was your best option. Me I don't see anything wrong with it except I would have stood where I could see him and he could see me. It is not illegal to open carry in your house or on your property. And for that matter as long as you can convince everyone you felt threatened you can draw down and ask them to leave. Where I live you would be lucky to have a LEO here in 20 minutes more like 30.
