Re: Cameras, security guards, and calls to the police.
Had they got involved, I'm sure they would be scared to death of civil liability.
Sue happy people caused policies like that to be written. I see it almost daily in our polices and regs at work...it's much of a cover yourself thing.
Though Texas PC offers a defense if you act in defense of a 3rd party, you are not necessarily immune from civil liability...as we know as CHL holders.

Actually you are--that was enacted in 2007.gigag04 wrote:Though Texas PC offers a defense if you act in defense of a 3rd party, you are not necessarily immune from civil liability...as we know as CHL holders.
Texas Civil Practice and Remedies Code, Section 83:
ETA: That applies to injury or death to someone committing assault, etc. If an innocent bystander is injured you may still be liable for damages.Sec. 83.001. CIVIL IMMUNITY. A defendant who uses force or deadly force that is justified under Chapter 9, Penal Code, is immune from civil liability for personal injury or death that results from the defendant's use of force or deadly force, as applicable.

CNN
This type of policy is not much different, except for the level of intensity, than in the case where those HEB or Walmart employees get fired for chasing down purse snatchers or shoplifters because the policy says you can't. These policies specifically state what their actions should be, and you run the risk of being fired or sued - and this CNN dufus that has self proclaimed all-knowing "common sense" would probably turn on a dime if a CHLer gets into a newsworthy incident to protect himself or another human being from danger.
Granted, I like to see the brave soul that says 'heck with policy', 'heck with the job' and steps in to do the right thing. I hope I would be one of those, but you never know until it happens to you.

I believe there is safety in numbers..
numbers like: 9, .22, .38, .357, .45, .223, 5.56, 7.62, 6.5, .30-06...

Policy or not they should have cowboy up and helped that little girl. At the beginning she even tried to put the guard between her and the attacker. As a father of 3 girls I would rather help out and be fired then do nothing.
Reminds me of the video where the big big guy comes in and pommels another guy in a pizza parlor because he said something about the big guy's girlfriend cutting in the long line. There were at least 10 men standing in the line just watching this guy get his head beat in. All of them just stood there waiting for someone else to do something.

They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety.

If you're a security guard making low low security guard hourly wages and your supervisor has specifically told you "DO NOT GET INVOLVED; JUST CALL THE POLICE. IF YOU GET INVOLVED, YOU FACE DISCIPLINARY ACTION UP TO AND INCLUDING TERMINATION" are YOU going to get involved and risk your job? Risk being unemployed in today's economy? Risk not being able to put food on the plates of YOUR FAMILY?
Basic human decency says intervene, of course. But bogus civil lawsuits brought by attackers against those who foil attacks (and the companies that write policies seeking to avoid such suits regardless of circumstance ) are what is to blame here.

Rick Sanchez is notoriously anti-gun, but he's killed more people with his car than I have with a gun.austinrealtor wrote: 110% Rick Sanchez is a blathering idiot!

when you have lawsuits like this I dont blame anyone for not intervening. You lose your job and now have to fend off a lawsuit.

Skylight was painted black, same color as roof. Not a great "Defense" but the law allows it. Now if he was a maintenance worker or not in the middle of a robbery, it wouldn't be such a big deal.Smily wrote:when you have lawsuits like this I dont blame anyone for not intervening. Skylights are often tinted black to save energy. Its hard to see things at night especially when you stealing the lights!

Well this is my first post I have ghosted or lurked or whatever its called but I have been following this site for a few years. I was a member at the angelina and rifle pistol club but moved away. Now that, that is out of the way.
If your not willing to step in between a (seemingly unprovocted) attack on a kid you are NOT a man.
The lady Brooke Baldwin said the gaurds are there to keep people out of the way of the busses and to perhaps to fix equipment. The same fore neccesary to keep some dummy from walking infront of a buss would have worked in this situation.
