Eligibility question...
Hello everyone. I am new to the forum and in need of assistance. On 06/09/2005 I was arrested for "DRIVING WHILE INTOXICATED", I was placed on 2 years probation and 24 hours of comunity service. I had to attended alcohol abuse classes, I recieved a certificte for completion of the class. My question is: Do I have to disclose this class?
Re: Eligibility question...
You don't have to disclose the class but you do have to disclose the arrest and the disposition of the charges.
Re: Eligibility question...
Gotcha, on the arrest info I have theres (2) dates of court dispostion: "COURT STATUS A" COURT DISPOSITION DATE 11/16/2005
"COURT STATUS B" COURT DISPOSITION DATE 12/26/2007. Any idea why theres two dates?

Re: Eligibility question...
...prolly your "end-of-probation" date...I think they go by how long since you finished punishment/parole, not the date of arrest...
...I thought wrong...GC411.172(a) (8)" has not, in the five years preceeding the date of application, been convicted of a classA or Class B misdemeanor..."
...thanks, Boss!!!

Re: Eligibility question...
The 5 year exclusionary period begins on the date you were "convicted" or given deferred adjudication, not when probation is over.LaRue32 wrote:Gotcha, on the arrest info I have theres (2) dates of court dispostion: "COURT STATUS A" COURT DISPOSITION DATE 11/16/2005

Re: Eligibility question...
Thanks for the input guys, from what I gathered I'll be able to apply on 11/16/2012..I was convicted on 11/16/2005.

Re: Eligibility question...
If your conviction date was 11/16/2005, you were eligible on 11/16/2010 - 5 years after the date of conviction.LaRue32 wrote:Thanks for the input guys, from what I gathered I'll be able to apply on 11/16/2012..I was convicted on 11/16/2005.
Re: Eligibility question...
I talked to someone today in austin, I was told its 5 years plus another 2 because the state sees it as if you were revoked.???

Re: Eligibility question...
Did you have a previous license that was suspended or revoked?
Re: Eligibility question...
No, but the person I talked to sounded pretty confident that it was 7 years, not 5.
Re: Eligibility question...
I believe they were confused and quoteing the revocaiton. GC §411.172 says 5 years prior to the date of applicaiton. http://www.txdps.state.tx.us/administra ... chlaws.htm" onclick="window.open(this.href);return false;LaRue32 wrote:No, but the person I talked to sounded pretty confident that it was 7 years, not 5.

Re: Eligibility question...
That is absolutely bogus. If you have never applied before, you have never been revoked, it is 5 years from the date of conviction. Period. End of story.LaRue32 wrote:No, but the person I talked to sounded pretty confident that it was 7 years, not 5.

See the post above for our own moderator Crossfire. She is a top notch instructor and teaches classes at Cabela's in Fort Worth. The classes are very informative and fun. And one of their range safety officers is an extremely intelligent and good looking, strapping hunk of a guy (if I say so myself)LaRue32 wrote: Can anyone recommend a good class in fort worth?
