A question about deferred adjudication

I have asked a couple of other instructors and I get back "good question". A man was arrested and charged with a felony drug charge. The agreement sent him to a halfway house for 6 months and 3 years probation. Is a halfway house concidered the same as prison? Does this come under the deferred adjudication excemption? My answer so far is for the fellow to call the state for clarification. Anyone have an experience with this? any assistance will be appreciated. Thank you.

I would say if he was 'sentenced' to a halfway house, then given probation, he was found guilty and incarcerated. It will all depend on the dispostion of the case. You can get a copy of the disposition from the court clerk at the location where the case was heard. A copy of that would be needed for DPS anyway.
