Shooting qual waiver for military shooting records question

I am a new CHL instructor and have a question for you. I have a guy asking about using his military shooting records to take the place of doing the shooting qualification portion of the class. He said he saw it on the DPS website that you could do that, but I am having a hard time finding it. Also, if this is the case, do his military records need to specify that he shot with a semi-auto pistol or a revolver? If all that checks out and he can forego the shooting qualification, do I leave that portion of the CHL-100 blank and he sends those records in with the CHL-100?

I can't answer all your questions but here is the main part to it:
Texas Government Code Sec. 411.1881. EXEMPTION FROM INSTRUCTION FOR CERTAIN PERSONS.
(a) Notwithstanding any other provision of this subchapter, a person may not be required to complete the range instruction portion of a handgun proficiency course to obtain or renew a concealed handgun license issued under this subchapter if the person:(1) is currently serving in or is honorably discharged from:(A) the army, navy, air force, coast guard, or marine corps of the United States or an auxiliary service or reserve unit of one of those branches of the armed forces; or(B) the state military forces, as defined by Section 431.001; and(2) has, within the five years preceding the date of the person's application for an original or renewed license, as applicable, completed a course of training in handgun proficiency or familiarization as part of the person's service with the armed forces or state military forces.
(b) The director by rule shall adopt a procedure by which a license holder who is exempt under Subsection (a) from the range instruction portion of the handgun proficiency requirement may submit a form demonstrating the license holder's qualification for an exemption under that subsection. The form must provide sufficient information to allow the department to verify whether the license holder qualifies for the exemption.

The shooting portion is the most fun part of the class.
You are not going to be leaving any earlier if you do not do it. You will just be sitting in the classroom by yourself while others are having fun!

Not sure when you took your class, but it should have been covered. It is also in the Instructor's handbook under the government code listing what is required for the militray exepmtion. It is here in the code

That looks like a law for DPS not for instructors.

I do not believe there is a specific form for this. A range qualification card or letter from the RSO or CO have been sufficient for previous students of ours.

He will need to show proof of qualification with a pistol and must still take 10 hours of instruction. He may assist at the range as a safety officer or in some other capacity. But he MUST take the complete 10 hours to get his license. So, why not go ahead and shoot.

For the CHL-100, just complete the classroom portion. I also put "NA" in all range-related areas to make sure nothing magically shows up there.
When I originally asked DPS about proof of military qualification, the response indicated that scorecards were not sufficient and that the proof must be from the person's records. All my military students who chose not to shoot have submitted printouts from their online records, such as Marine Online.
Some reasons students may not want to shoot include high cost of ammo or congestion at busier ranges. Regardless, I respect their choice.
ETA: If a student qualified in the last five years, it was with a semiautomatic. DPS seems to know this.

That's what we do. If they sit through the whole lecture and pass the written test, but don't want to shoot for some reason, they get a CHL-100 for nine hours with "PASS" under Classroom and "N/A" under Proficiency. What they do with the paperwork is up to them.

Unofficially, I heard some students are using it to apply for a nonresident license from another state. I know ammo is hard to find lately and some states don't require shooting. I also know Texas is stricter than some other states when it comes to deferred adjudication and child support. But it's not my place to judge.

Can't imagine why anyone would not wish to shoot. That's the best part of the course. You get to admire the other folks' firearms, show yours off, and make some noise. That, and it's nearly impossible not to qualify. My goal for the next requal is a perfect 250.
