I had a student ask: "If you're in your own home and had been drinking, what are the ramifications of shooting an intruder", only as it relates to the alcohol? My best answer so far is that it depends on may other factors, such as, were you threatened, however the alcohol may skew any mitigating circumstances...

My best answer would be "none".

Someone might try and make a big deal out of it, but there is no law against drinking in your own home if you own firearms. If you are justified in using deadly force then that should be all there is to it. If not, then the alcohol will severely complicate things.

Pretty much. Because if deadly force was not justified, it will be used against you by saying that it impaired your judgement and ability to think rationally.

Don't we have the basic right in Texas to defend our property?

I would feel really very threatened if someone were to break into my home while I as there.

It should have the same ramifications as being at home with a cold, taking a full dose of Nyquil, and having to shoot a home invader at 11 in the morning.

We DO live in Texas and have the right to defend our property (and self, and loved ones, etc) in our homes from unwanted and unprovoked intrusion. However, no matter where you live, there will always be someone looking to use SOMETHING against you, no matter how much in the wrong the bad guy was and how much in the right you were. That said, this isn't New York, California, or Illinois and I would like to think that drinking alcohol IN YOUR HOME shouldn't be a factor IF the shoot was justified.
