HB 95 - Requires gun shops to report attempted buys. Makes knowingly attempt-to-buys illegal

(a) A person commits an offense if the person:
........
(7) knowingly acquires or attempts to acquire a
firearm, while the actor is prohibited from possessing a firearm by
a state law or a federal law other than 18 U.S.C. Section 922(g)(4).
(e) A licensed firearms dealer under the Brady Handgun
Violence Prevention Act, 18 U.S.C. Section 922, who declines to
transfer a firearm to a prospective transferee because the National
Instant Criminal Background Check System indicates that the
prospective transferee is prohibited from possessing a firearm
shall notify the Department of Public Safety.
SECTION 2. Subchapter D, Chapter 411, Government Code, is
amended by adding Section 411.0525 to read as follows:
Sec. 411.0525. INVESTIGATION OF LICENSED FIREARMS DEALER
REPORT. (a) If the department receives a report under Section
46.06(e), Penal Code, from a licensed firearms dealer under the
Brady Handgun Violence Prevention Act, 18 U.S.C. Section 922, that
a person prohibited from possessing a firearm has attempted to
acquire a firearm, the department shall initiate an investigation.
(b) If the department's investigation under this section
produces evidence that a person may have violated Section 46.06,
Penal Code, the department shall refer the case to the appropriate
local authorities for further investigation and possible
prosecution.

It would be better to require the NICS administrators to report denials to the offices of the Attorney General of the United States and the Attorney General of the state where the attempted sale happened. They can follow up to investigate the attempted purchase, and prosecute if warranted. It seems like this would be a "common sense gun law" the Democrats could support, if they're sincere in their claims to want to keep guns out of the hands of criminals, rather than engage in partisan harassment of law abiding gun owners.

If a person had some issue in their past, and were not sure if that would be a problem, they would be afraid to even try, as they could be arrested. That's why the Socialists want this passed. There should be a process for someone to check whether they could pass the required BG check. It's not always clear.

How about a bill making it a felony punishable by prison for a legislator to attempt to restrict gun rights? I’d support that one!
