I could see someone making an honest mistake - my wife thinks I should drink water, I prefer soda. She hands the kids and me cups that she just left the register with. I get my soda only to discover she meant for me to get water, I go to jail.

Don;t think so. This guy refused to pay for his soda, so the cops were called. He is an habitual criminal, and since this was his third strike, he goes to jail and the taxpayers now get to pay for the soda and everything else he eats and drinks.

That’s when the cops were called.

The way I read the article, he actually got the charge because he refused to pay for the soda. (He had the chance to fix an honest mistake). Even after that it looks like they just asked him to leave. It wasn't until he refused to leave that the cops were called.

The charge is probably trespassing since he refused to leave...and since it's the third offense it's a felony. He's not going to jail for accidentally using the wrong cup for $1 worth of soda.

Yep, I should have read the article.

Water, milk, black coffee, red wine, and beer here. . . I dropped cokes (Dr Pepper) about 4 years ago and haven't looked back.

I grew up in the 80's and 90's when we lost our mind and families started regularly drinking sugar for both lunch and dinner. They're so sweet I can't even bear a sip anymore. We let the kids have the occasional root beer float, but that puts cokes in the category of desserts to them, which is where they belong IMO.

As to the thief, call him what he is and charge him. Petty crimes are still crimes.

A thief is a thief, period. I have zero tolerenace for stealing anything, big or small.

...I've been digging and don't see why third strike applies here...from what I can find, it's not that "because it's a third offense it's a felony" but that the three offenses must BE felonies...
