Davis had prior arrests for aggravated assault and theft. He was released from his last stint in jail on July 22.
...and yet they system continues to put these people back out onto the streets.

I don't know how well this is going to go for the guy who applied the choke. It's not like in a movie, where people just go instantly from resisting to dead. The BG would have gone limp and unconscious first, then later died from oxygen or blood loss. It could be argued that the hold should have been released there.

He is in New York so the victim of the robbery will most likely be arrested and charged. Bloomberg can't have his voting base killed off.

I would agree with this except that this incident has gone viral.
No way is NYC gonna press charges in this situation.
They already have their hands full trying to kick loose those two yayhoos that brought their CHL weapons to the 9/11 memorial and Empire State Bldg.

It's a good thing he wasn't a former "professional wrestler." The media would say that his hands were deadly weapons.

I wouldn't want to be that dude.

Granted, we don't know all the facts, however, I can see how a prosecutor could throw out a manslaughter charge. You can choke a muldoon out, however, if you stop applying the hold when said muldoon goes limp, you're not going to kill him....usually.

Unless this guy can prove he stopped applying the hold as soon as the criminal went limp, he may have some issues.
88 day wait for the state to approve my constitutional right to bear arms...
