Re: TX Dad defends daughter (4)
Only if the BG didn't start fighting with the father. I mean, for me, I don't care what nefarious hypothetical deed I was caught doing... If someone kicks me, they're gonna get something in return even if it is just to stun them or knock 'em back while I escape. They, of course would have no way of knowing that I'd be trying to run away, and IMHO be perfectly justified in using deadly force against me to defend themselves.canvasbck wrote:OK, let me get this straight. According to what has been stated above:
From a strictly legal perspective if the father had been armed and shot the guy in the head while he was committing the assault. The father would have been in good shape legaly even though he endangered his daughter from a passthrough, ect.
If the father kicked the guy in the ribs, knocking him free of the daughter before placing a round into his cranium, he has committed murder.
I am not a lawyer, nor have I played one on TV, nor did I stay at a Holiday Inn Express last night, nor should anything I say be taken as legal advice. If it is important that any information be accurate, do not use me as the only source.

Grand Jury declines to return an indictment: http://www.foxnews.com/us/2012/06/19/te ... -homicide/
Odd that the URL title says something different though. Fox must have been preparing for something else.

Edit: Aha! This quote from the story explains the URL -Authorities say a Texas father who beat to death a man who tried molesting his 4-year-old daughter will not be charged.
Officials said the grand jury met Tuesday and declined to return an indictment against the father in the death of 47-year-old Jesus Mora Flores.
Earlier, the Lavaca County Sheriff's Office said in a statement that the death would be treated as a homicide investigation, and the case was sent to the grand jury.

Assault of the daughter perhaps, but who is to say the father did not feel threatened himself now, and was defending himself against the assault.. Only two folks know that answer,, One is dead, the other will tell his side to some folks who will decide.sjfcontrol wrote: He's suggesting that after the assault has been stopped, it is no longer justification for the use of deadly force.

An assault on the father, unless it entailed deadly force by the attacker, would not justify deadly force by the father in response.bronco78 wrote:Assault of the daughter perhaps, but who is to say the father did not feel threatened himself now, and was defending himself against the assault.. He was already no billed but it's still smart to decline requests for interviews.bronco78 wrote:Assault of the daughter perhaps, but who is to say the father did not feel threatened himself now, and was defending himself against the assault.. IMO, interviews could do him harm and no good would come from them.tacticool wrote:He was already no billed but it's still smart to decline requests for interviews.bronco78 wrote:Assault of the daughter perhaps, but who is to say the father did not feel threatened himself now, and was defending himself against the assault.. You might just have a lot of trouble keeping your job, among other things, some much harder to replace.knotquiteawake wrote:I think its possible he will get charged if the following is true:
http://www.theblaze.com/stories/he-got- ... -to-death/" onclick="window.open(this.href);return false; If he pulled the man off his daughter then at that point the assault has been stopped. To then beat the man in the head to death looks more like vengeful homicide. Once the crime is no longer in progress I think he would not be covered by the law anymore. If he pulled the man off his daughter how then is deadly force necessary? The crime has been stopped. After pulling the attacker off of her, the father repeatedly struck the man in the head.
What do you guys think? If I were the prosecutor that is the direction I would go with it.

"The Lord is merciful and gracious, slow to anger, and abounding in mercy." (Psalm 103:8)Associated Press wrote:SHINER, Texas — A young Texas father who beat to death with his fists a man molesting his 5-year-old daughter will not be charged, authorities said Tuesday as they released a dramatic 911 tape of the dad frantically pleading for help before the hired ranch helper died.
A Lavaca County grand jury Tuesday declined to indict the 23-year-old father in the death of Jesus Mora Flores, 47. Prosecutors said the grand jury reached the same conclusion as police after reviewing the evidence: The father was authorized to use deadly force to protect his daughter.
