More on the story. A retired veteran called 911 to report two strange women knocking at his front door. He apparently did not answer and the door and the women broke a window and entered the home. He then reported to 911 that they were in his home. He fired three shots with his 20ga shotgun.

The one teenager may loose an arm the other may be paralyzed for life. They arrived in a stolen car that was found at the scene.

Since it was a shotgun they are both fortunate to be alive.

The next sound neighbors heard was at least three blasts from a 20-gauge shotgun used to kill deer.

Nighttime only applies to protection of property for theft or criminal mischief. These women had committed burglary of a habitation.

If he believed the women had taken something, then he could potentially have justification for protection of property to keep them from escaping with it. However, if they hadn't stolen anything he will have to prove that he was still in fear for his life or other bodily injury if he fired as they were escaping.

The article states that one suspect was found inside the house, and the other managed to run outside.

That sounds like both were inside when the shots were fired, but early news articles are notoriously short on both facts and accuracy.

Here's another story on it. Women were going house to house, banging on doors and throwing rocks. In the video story it doesn't look to me like the car was riddled with gun shots, but covered in fingerprint power. Sounds like the guy shot them when they came in the house if they were hit in their torsos.

One of the suspects collapsed inside the house while the other stumbled outside and across the street to a neighbor’s front yard.

The homeowner was unharmed in the incident.

"I saw a girl run out of the house and a guy chasing after her walking speed," said witness Brian Valera. "He was very, very angry. He yelled very threateningly at them."

Here was my concern for our shooter.

Brian's not a great witness for his neighbor.

My other concern for our shooter is probably both these woman have boy friends and fathers, who might be very upset.

Seems like the shots were fired inside the residence. He may have ran out after them but that would seem inconsequential considering that anger could easily mistaken for panic or stress from the situation. Based on what we have I would not be too concerned about a GJ. Dad or BF might think twice as well. Agree with you though. Neighbor is not helping.

A KHOU video story from yesterday interviews a South Texas College of Law professor that states under Texas Law, the homeowner was within his rights. The story also draws a parallel with the Joe Horn shooting in Pasadena 7 years ago where Mr. Horn shot two burglars that broke into his neighbor's house and shot both of them on the street as they were leaving his neighbor's house. The grand jury did not indict Mr. Horn. However, Quanell X did hold demonstrations outside of Mr. Horn's house arguing that burglary should not be a capital crime, even for illegal immigrants with prior convictions as was the situation in Mr. Horn's shooting.

In the shooting from the other day, I doubt that the homeowner will be indicted. I am confident that some plaintiffs attorney will encourage the ladies to file civil suits for millions of dollars in damages that they will never be able to spend when they are in prison.
