Teens when I was growing up were more worried about getting shot with rock salt than we were buckshot. Of course back then that was an acceptable form of "property owner inflicted judgement" for being somewhere you shouldn't doing something you shouldn't. The worst part was having to explain it to your own parents which meant double punishment.

Of course I was a good boy and never had to worry about that sort of thing...

Texas also has limits on punitive damanges for tort cases. If the kid just caught a couple pellets with minor injuries, his damages aren't going to be enough to warrant taking the guy's house. That kind of ridiculous lawsuit is what the tort limits were supposed to control. You ought to be able to recover damages. It is not supposed to be a license to destroy someone's life and take all their stuff. And that is assuming you win and full responsibility is put on the shooter.

Also, I am not certain the court can take away the guy's homestede in a court action anyway. The worst you could probably do is put a lien on it. Other assets are likely fair game.

Yep...remember it well, but gotta admit there were a lot of times mine THOUGHT they knew, but were mistaken. However, we probably didn't fool them as often as we thought...by the time my brother and I were in high school, my Dad had an outside stairway built up to our second floor bedroom so we wouldn't wake everyone else up when we tried to slip in late.

TP-ing a house is stupid. But non lethal stupid games should win non lethal stupid prizes. Instead of a gun the offended homeowner (or neighbor) should have brought a a normal strength water hose. One good turn deserves another soaked clothes is a fair punishment for TPing a house. It also ruins whatever TP they have left. I bet he wishes he did now. Even if he is released without charges the damage done by the legal system will be extensive.
