Based on the news story, catching the dude in the car and thinking he had a gun is pretty clear justification. However, IMO I don't see the need to shoot #2. If the guy was merely driving away from a car burglary, he didn't pose a threat. In addition, he wasn't a fleeing violent felon. Sure he may get cleared for it, but he has to live with it.
