Walking into your house while being burglarized!

#1

Post by Beiruty »

Happened to this firefighter. Most likely had a gun on him ( no CHL is needed for firefighter in TX?)

1 BG is DEAD.

Maybe. If there is evidence of break-in, then BG could be. The first I thought BG do not drive their cars to their target houses.

A fireman can conceal carry without a CHL? Is that right?

Not to my knowledge. My son-in-law took his CHL from a fellow Captain who is an instructor.

Unless a firefighter is also a sworn peace officer (fire marshal, arson investigator, etc.) he needs a chl just like everyone else. I didn't see anything in the article that said he was doing anything that required a chl though.

I would imagine that carrying from your car to your house under the MPA pretty-much covers anyone without a CHL.

You would be correct, as long as they dont fall under the four exceptions.

We must never take our security for granted, even (or more) when we are at home. I am never "happy" that someone died, even a bad guy, but I am very pleased that the homeowner and his family are ok. I can live with that difference.

:iagree: "Some" firefighters are also "peace officers" ....

Texas Code of Criminal Procedure - Article 2.12.
http://www.statutes.legis.state.tx.us/D ... m/CR.2.htm" onclick="window.open(this.href);return false;
Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace officers:

...
(36) the fire marshal and any related officers, inspectors, or investigators commissioned by a county under Subchapter B, Chapter 352, Local Government Code.

Subchapter B, Chapter 352, Local Government Code
http://www.statutes.legis.state.tx.us/S ... LG.352.htm" onclick="window.open(this.href);return false;

All firefighters are not Paramedics nor EMTs nor Peace officers .... some are.

Technically according to 46.02 you are only covered on the way to your car and are breaking the law on your way back from the car if you have to walk across anything that isn't your property.

"(2) inside of or directly en route to a motor vehicle that is owned by the person or under the person's control."

Wilson will be placed on administrative leave while police further investigate the crime.
What I don't get is why the homeowner has been placed on administrative leave A) for a shooting at his own home, B) while off duty and C) is in a completely different city from where he is employeed....how does that work?

Probably to give him time to process what has just happened to him. Perhaps the city wants him to seek counseling. Just me guessing though.

Liabilities to city, cheaper to put him on admin leave with pay then to be sued.

The city can't be sued any more than my boss or yours for things that happen while off duty.
