Off Duty HPD Officer Shoots Man
An off duty HPD Officer shot and wounded a man suspected of breaking into his pickup truck and stealing a handgun.

A followup story names the suspect.
Police said Rogelio Rodriguez, 20, is charged with burglary of a motor vehicle, a misdemeanor.
Those who cannot remember the past are condemned to repeat it.

Last I checked Burglary of a motor vehicle was a state jail felony, max 2 years. It used to be a 3rd degree felony, 2-5 years.

TPC § 30.04. BURGLARY OF VEHICLES. (a) A person commits an
offense if, without the effective consent of the owner, he breaks
into or enters a vehicle or any part of a vehicle with intent to
commit any felony or theft.

(2) any physical object connected with the body.

Theft of a firearm is a state jail felony though...

Yeah, once the act of theft starts, then the rules change. It is just the act of burglary of a motor vehicle that changed to a misdemeanor.
