BIL arrested - Cops entered house no notice/announcement
So last weekend my BIL was having a fight with his GF in the backyard of their house in Houston. Out of the blue a group of folks come rushing in the gate screaming to stop what they are doing. He grabs her and pulls her into the house and locks the door. Turns out it was the cops, who failed to announce who they were as they came through the fence gate. They busted in the back door, took him to the floor and gave him a nice blow to the back of the head.
I understand they got extra hot because in some strange world they 'fled', but in my world he was protecting his GF and himself. I would have had a hard time not drawing a weapon if I had one on me. But of course that would have ended really bad, as cops shoot back when they see a gun.
Hot cops ended up equaling a mis resisting and a fel domestic assault for a verbal only altercation. So mega legal bills coming.
So if somebody came into your backyard yelling, do you shoot? Run? or stay where you are?

Yes, both. But late at night, no lights in the backyard. Cops had flashlights, but obviously not shining on themselves, rather at their 'perps'.davidtx wrote:No uniforms? No badges?

How long and how loud does a couple have to argue for the police to show and prepare a plan to apprehend a couple people airing their dirty laundry to the neighborhood?

I dont think anyone would be able to get in to my backyard and come out untouched, Dont think I would need to worry much with 3 dogs.

You run. Unless it's the cops, then you stay unless you want a wooden shampoo. It's called hot pursuit for a reason.AustinMRH wrote:Hot cops ended up equaling a mis resisting and a fel domestic assault for a verbal only altercation. So mega legal bills coming.

Police don't need a warrant or notice/announcement to enter a house chasing a suspect in a crime, especially if he is dragging his victim with him.
Whats a BIL? Brother in Law? If so, this is his girlfriend not your sister? If it was my sister, I'd want the police right in there taking him to jail.

That is called "hot pursuit" so they do not need a warrant. IANALphilip964 wrote:Police don't need a warrant or notice/announcement to enter a house chasing a suspect in a crime, especially if he is dragging his victim with him.
