unfortunatly thats not gonna happen, he already has a counseling letter at the least in his 201 file and his CO has probably put notes in his restricted file that blew his career to bits
1st, a DA4856 developmental counseling form is a local document only, and is destroyed upon transferring units.
2nd, there is no such thing as a 201 file any longer, personal records are digital and counseling forms have not been placed In a personal record for more then 30 years now.
3rd, this should effect him no more then a closed case with no conviction might effect a person applying for a chl.. You have to disclose it, on say a security clearance application, but not a big deal. No one else will ever know in a future unit unless he tells them.
The lasting effects of this event are personal (financial) in nature. Not professional.

yes did the officer document his belief of suicidal ideation/action, did he document that he asked/told the actor to leave his weapon at home, what if any was his rational for the above, did he document anything about the actor and alcohol of any sort, not the wife. basically the entire narrative on the report so that we can see if the officer was predisposed to having a tendancy towards the actor as either disbelief of his story or disregarding any statements or misinterprtation of comments made. Also what department/city, I might like to file a FIA.

A plea bargain was offered on lesser charges, when Mr Sampson's lawyer pointed out to the ADA that no violation occurred due to the hospital not having complied with requirement to post 30.06 or verbally notify, neither of which were done..the charges were changed well after the night of the event to carrying while intoxicated.
The sole evidence presented in discover at this point is the accused admission he had had shared wine with is wife over a 6 hour period,, and the LEO stating he smelled alcohol on the accused breath.
I say again that the soldier is being prosocuted for contempt of cop, since there is no actual such law on the books the DA is looking for anything he/she can find to jail the individual. My personal belief is that because the charges are an ever evolving random set of things thrown out there to see what sticks the Judge should dismiss all charges, hold the DA and the arresting Officer in contemp for 6 months to remind both of them that contemp of cop does not exist period. if the DA and Officer can be held responsible for bogus charges they may think a litte more before just throwing out bogus stuff and hopeing something works because the guy didn't do exactly what the LEO illegally told him to do.

The questions about weapons may seem valid on the surface, however the medic should advise the LEO as the medic probably has a better line on suicidal ideology than the officer, extrapiramidal reactions are not usually the cause of concerne to suicidal ideation, should the woman have a history of similar behavior the medic should know and move toward that DX, however with the available info this seems like the LEO ran the DL of all parties involved and made a blanket statement or order(civilian leo can't give orders) or directive that was not followed, we have no duty to follow such directives on the 3 3 rule 3 seconds or 3 feet. I am not really being as bad as you might think but I dislike the attitude that civilians must do as the LEO says cause he ain't a civilian(yes he/she is cause they ain't military) the leo gets upset because he or she believes that they have absolute authority and control over another civilian and contemp of cop applies, but there is no such charge or law or rule, a LEO is a CIVILIAN period, I have the right to ignore anything he says period, just can't interfere with him doing his job.

and the correct answer to that is noneya, fact of the matter is that an adverse reaction to medication does NOT warrent any questions about fire arms, movies, or anything else except what meds and how much of what alcohol period. anyone that excuses the officer and his attemp to control anyone is well..... you know. This with the available information is nothing more than a witch hunt, gotta make sure the cop is right and the DA seems to grasping at anything that will help keep the cop from looking foolish and embarressing the DA and City leadership.

the soldier didn't do exactly what the civilian LEO told him to do, nothing more nothing less. this is really a case of Lese Police Officer and is being prosucuted by grabbing at the straws that broke the camels back.
