It's unreasonable to expect software to fix the problem when it can be defeated. iPhones can be jail broken and everything else can be hacked. The problem isn't the tool, it's the people who use the tool in an improper manner. Are you a proponent for smart guns?
Stop with comparison to anti gun idiots that support smart guns as that is insulting, ridiculous and uncalled for as they are two completely different situations.

The average person is not going to jailbreak their phone in order to defeat the texting while driving safety features is they are installed by the manufacturers of carriers. Like I said, nothing is 100% and I do not believe it should be forced by legislation.
phone mfgs aren't going to force it on their customers without leg, because their customers don't want it, and if they are forced to put it on, yes the average person will figure out how to break it, that will be the first thing they do.

As a libertarian, I don't want to see laws dictating exactly what you do. I do not want to see laws against texting and driving. What I do want to see is people who injure others because they are obsessed with their phones charged with assault. We do it for drunks, why not for someone who injures/kills because they couldn't put their <darn> phone down? If it can be proven that you injured/killed someone because you were intentionally ignoring everything around you, there should be consequences! Making the conscious decision to stare at the phone screen is, IMO, just as bad if not worse than deciding to drive after a night of drinking. At least with the drunk, there is a chance that they will see what's going on and react, the person who CHOOSES to stare at the phone sees nothing.

you are contradicting yourself. first you say you don't want to see laws against testing and driving, then you say you want them charged with assault....you have to have laws in order to charge people, so which do you want? :???: Not sounding very libertarian...

the new texting law has so many exceptions people were laughing at Zafferini as she was reading it. I can't standing texting and driving, remember I live right next to New Braunfels, but a cop can't tell if a person is texting, picking a spot of lint off their pants, or scratching a mosquito bite. If the the officer sees them and stops them, all the person has to do is say that they had reason to think it was an emergency, and the officer can't do a thing about it. There are lot's of other loop-holes, too....I just remember the "had reason to think it was an emergency" one.
