I agree with you as far a reposession, but even then there is a dangerous conflict with Texas property law when it involves taking a vehicle at night. A shooter could rightfully (or dishonestly) claim that they thought a theft was in progress. Say that the wife had been making car payments and had fallen behind but the husband who came across the wrecker had no clue.Keith B wrote:Excuse me? I had thought this was about a private property towing, of which I was referring to.
In my opinion, this practice is often abused and borders on legal theft and extrortion. Unless a vehicle is truly blocking access or creating a hazard, the car owner should be hit only with the same ticket or "orange sticker" they would get in a public area. And many drivers hide in wait ready to strike, even if it's the empty lot of a closed business on a Sunday morning. If you ask me, it takes a certain type of lowlife to make a living that way.
It could also be argued that this practice puts people in danger by leaving them stranded in bad areas,

The whole business of towing in such scenarios is a racket, and as far as I'm concerned, the drivers have it coming.
