I even offered to let her look me up on their system because I was sure there were a ticket or two on there. I tried to get into radar specifics and tracking etc.. but that went no where with her. Then I pulled out the video from the cruiser I got from the police station and showed it to her on my Ipad. She said "Well, if I were on a jury if I saw this video I don't know if I could tell you were guilty beyond a shadow of doubt so I'm dismissing it".
That was good enough for me. I said "thank you for taking the time to listen to me" and walked out. I'm a pretty happy camper right now.
Just thought I would post an update.
Congrats on the win!
What were the steps you had to take to request the video?
I assume the cop was filming BEFORE the traffic stop took place. Is this common? Are their cameras always recording? I was under the impression that they didn't turn on until physically activated by the officer or automatically when lights are activated.
Anyone know?
Thanks, I just went to the PD and asked if I could get a video from my ticket. They said sure and I filled out a request form and paid $5 and three days later they called me to come get it. They were really nice about it.
The PD that gave me the ticket basically have DVR's in their cars. They are always recording but when they do whatever action it is that needs recording it basically places a marker 30 seconds back and that recording is kept on the DVR.

I think I'm going to ask for a trial after reading the responses here I know it's easier to pay the ticket and in every ticket I have gotten that's exactly what I did but this one bugs me. I know I wasn't going the speed he said I was going. The more I think about it I'm sure he had a radar issue. I'm going to ask for a jury trial and ask for radar calibration records. I'm also going to inquire on whether he did whatever he needed to go from setting still to a moving radar. Someone mentioned they have to change the mode or something. If I lose I'll pay but at least I'll have the satisfaction of knowing I didn't take it lying down.

What I'm saying is even if I were going the posted limit he still would have pulled me over because I wasn't going nearly as fast as he said I was. He would have probably gotten me for going 38 in a 30 if I were driving he posted limit. Like one of the previous posters posted I wonder if he didn't have his radar gun in a stationary setting of something.

I cannot picture any situation where you could appear in front of a Judge and argue against an Officer successfully that even though you were speeding, you weren't going as fast as he thought.
Almost every city in Texas has Deferred Disposition. Here is a ling to Keller's website on the subject:
http://www.cityofkeller.com/index.aspx?page=461" onclick="window.open(this.href);return false;
If you qualify, it keeps the ticket of your insurance and off your driving record.
I know what your saying. Brotherhood and all that. I don't even really want out of it I just think it should be lower. I wasn't going as fast as he said I was but he said 48 and I was probably doing 38. I don't know that I'm going to have any luck proving it though.

I was stopped in the fine city of Keller today. According to the officer I was doing 48 in a 30. The engagement was OK and I did get a ticket. The thing that bothers me is that I had just pulled away from the stop sign and the officer was coming from the opposite direction. There were two cars in front of him and one behind so, I'm having a hard time figuring out how he got an accurate radar reading. My passenger even said he didn't think I was going 48 in a 30. Now, to be honest I was not going 30 but I don't think I was going 48 either.
I am tempted to protest this ticket but am I spinning my wheels? Normally I would do deferred adjudication and be done with it but I'm having second thoughts on this one. Also, if I take it to court can I still do deferred after the fact?
I'm looking for opinions especially from the officers on this forum. I'm not saying the officer was lying I'm saying I don't think he was accurate.
