the FBI’s abuses are confirmation that federal law enforcement agents are combing through the communications of Americans without warrants, in violation of Fourth Amendment protections against unreasonable searches and seizures.

“These opinions reveal devastating problems with the FBI’s backdoor searches, which often resembled fishing expeditions through Americans’ personal emails and online messages,” said Patrick Toomey, a staff attorney for the American Civil Liberties Union’s National Security Project. “But the court did not go nearly far enough to fix those abuses. The Constitution requires FBI agents to get a warrant before they go combing through our sensitive communications.”

The declassified FISA court ruling revealed that the FBI is the most prolific miner of data about “U.S. persons,” a legal term that means any U.S. citizen or foreign national legally in the country. Queries of this data are known as “backdoor searches.” In 2017, the FBI ran approximately 3.1 million searches related to U.S. persons, compared to 7,500 combined searches by the CIA and NSA during the same year.

Many of the FBI’s searches were not legally justified because they did not involve a predicated criminal investigation or other proper justification for the search, as required by law, according to Boasberg’s FISA court ruling.

The FBI had received a tip about his online account in 2019, but never located its owner.

The first person he encountered, Victor Gomez, also happened to be carrying concealed that day, but was ambushed at point blank and never had a chance.

Dicken had come to the food court with his girlfriend for dinner, and was seated next to a column and trash can. The instant the shots rang out, Dicken pushed his girlfriend to the ground, drew his Glock 19, braced himself on the trash can and opened fire at a distance of 42 yards. At this distance, Dicken fired four times, hitting the murderer twice, with Dicken pausing only when panicked shoppers ran through his line of sight.

The injured murderer, rifle still in hand, retreated towards the bathroom. Dicken closed to within 20 yards and shot the murderer with another four shots. The murderer started to go down, but was still struggling to make it to the bathroom. Concerned for potential further carnage, Dicken closed in to about 25 feet and fired twice more. The murderer slumped over and didn’t move.

I am a member of the Indiana gun owners forum as well. This incident of course has been followed there. One of the posters noted that Mr. Dickens’ lawyer Guy Relford, mentioned in the article linked by Paladin, has posted on his Facebook page that Mr. dickens used a stock Glock 19 loaded with blazer brass ball ammo.

This is what has the left most upset:

The facts speak for themselves: responsible armed citizens are the only viable defense against active shooters, and a skillfully deployed handgun user can most certainly take out a rifle armed madman. The Indiana Mall incident makes this crystal clear to everyone, and it's getting noticed. The indefensible irrationality of the gun grabbers whose arguments can be boiled down to Dicken should have let the shooter kill people until police could deal with him is highlighting their insanity and no one is buying that argument.

It would be a pretty EASY sell for defense that he could reasonably assume that there were additional mall guests in that bathroom, and therefore as the shooter was still carrying a gun that it was still defense of a third party.

If he threw the gun down and surrendered, then maybe...

Yeah I think that’s a pretty easy sell myself. Are we supposed to assume that he wasn’t going in there to reload, change guns, kill innocents in the bathroom, or come back out shooting?
