Re: NM: Hand gun with trigger pulled by Alec Baldwin in rehearsal kills one injures one

We guessed it, now it's confirmed:

Prosecutors Say Alec Baldwin Skipped Gun Safety Training
Statements and evidence show [ALEC] BALDWIN was not present for required firearms training prior to the commencement of filming. Statements, depositions from OSHA, and evidence show BALDWIN was provided only minimal training on firearms, even after [armorer and co-defendant Hannah Gutierrez-] REED requested more training for BALDWIN. In the deposition taken from REED, she stated BALDWIN had very limited training on the cross draw that was required for the scene on the 21st and limited training in firearms and how to check his firearm as to whether it was unloaded or loaded, in which REED felt was very important in his role as RUST.
He was too arrogant to get required training.

Chemist45 wrote: Sun Feb 20, 2022 8:32 pm K.Mooneyham relayed a conversation wherein an "Expert" claimed that actors never check the guns they are handed.
actors and actresses don't check the guns because it's too dangerous for them to do so and they don't know how to do it. He stated that he worked on many movie sets and only the armorer is allowed to check the firearms.
Here are some quotes from people in the industry:
George Clooney:“Every single time I’m handed a gun on the set — every time — they hand me a gun, I look at it, I open it, I show it to the person I’m pointing it too, I show it to the crew,” Clooney said. “Every single take.”

Nicholas Cage: It’s part of a movie star’s job to know how to safely use a gun, especially given that firearm violence figures so prominently in American film and TV shows.

Dean Cain: "Baldwin should have opened and checked the cylinder. Its standard safety protocol."

I'm sure I could find more quotes if I looked. These took me three minutes.
Unfortunately for Baldwin he was ALSO the co-producer and as such has responsibility as BOTH the person handling the firearm and the crew that supplies and checks the firearms... so a useless argument from his buds.

Script supervisor sues Alec Baldwin ( I assume for slander).

He said nothing in the script called for Baldwin to cock and fire a gun.

Well that’s interesting.
We should have known. Baldwin fakes for a living.

Re: NM: Prop gun in Alec Baldwin movie kills one injures one

oljames3 gets the credit:
Let me be clear—I have no idea if what I’m about to describe will turn out to accurately describe the events in this case. I read such a description of the events online, but have no idea if the person providing that description has any idea what they are talking about. Here we’re using that description of events not as a claim that they represent what actually happened, but merely as a hypothetical to explore the legal issues that could arise in this case.

The day was running long, the actors and crew were getting tired, another scene had to be shot yet again, and in an effort to add some levity to the circumstances Alec Baldwin, holding a firearm in his hands that he believed to be unloaded, jokingly told the director of photography Ms. Hutchins and director Joel Souza, “We have to shoot that scene again? How about if I just shoot you both, instead.” He then points the firearm at them and depresses the trigger, resulting in the gun discharging, killing Ms. Hutchins, and wounding Mr. Souza.

In that last hypothetical we have no innocent accident, and we have no mere civil negligence—instead, we have, with the pointing of the weapon at the victims and the deliberate press of the trigger, criminal recklessness.

Aagreed. Why did he pull the trigger? They were not filming.
The story is it was late in the day and they needed to re-"shoot" a scene and Baldwin grabbed a gun and blasted away at the individuals saying he was going to shoot them instead (in jest). It does appear to be criminal negligence, but I would expect that the local authorities will want to be very certain before an indictment is made. Don't know how New Mexico works with Grand Juries.

Wow!!! That's a seriously damaging interview, particularly combined with the TikTok video.
Yep. She made (another) poor decision ever agreeing to that podcast interview because a couple of the old codgers doing the interviewing clearly knew a thing or two about period-piece firearms. One of them mentions Remington swappable barrels, and then in the next breath they ask Gutierrez-Reed what different types of blackpowder firearms were on the set of the Nicholas Cage film. Her response was:
"Uh, it was mostly, oh, uh, Remingtons... There wasn't too many, you know; there wasn't a lot. There was a little bit of gunfire, but mostly just a couple of Remingtons."
And fast forward to 21:19 in the podcast when she's asked about the detail of the steps involved when an actor who has no experience with guns comes to get a firearm from her armory. Check out how much she mentions safety procedures and marvel at the depth of her displayed knowledge.

Her dad gave her a Colt Peacemaker last Christmas, and she also owns a Walther P22. That's the total extent of her personal firearm collection.
Sounds like she has very little real experience and no formal training.

The part where she says "all she knows is the wild west peacemaker stuff" and "she's gonna start branching out into other {weapon} stuff" is very cringe-worthy.

"Corners Were Being Cut": Baldwin Shooting Already Has The Makings Of A Blockbuster Tort Action
In the end, the liability may be delayed but will likely be considerable. What is clear is that personal injury lawyers will view the Bonanza Ranch as aptly named for civil litigation.
Since this didn't take place in California, Baldwin might not have as much overhead cover for his actions.
