No, it makes him a scofflaw. He's not a criminal until caught and convicted of a crime.

First of all, you're not a felon unless you've been convicted. Secondly, unless he was caught and charged with a crime somewhere along the way, there would be nothing to extradite him for. In Texas it's perfectly legal to own the firearms that New York has declared illegal.
