Im sure your not implying a berm, 20ft high and of most any depth it would take to pile dirt 20 high, is incapable of stopping the average handgun or rifle round....

Cant fix stupid.. Hit the target, where the range is designed to stop the bullets, or have bullets end up in areas not planned. :tiphat:

Liability wise, sure i guess you need to assume your shooters are ignorant and will not shoot in a manner the range is built for..
Plan for the worst kind of thing :thumbs2:

Berm, overhead cover at the target line back to some distance to the shooter line that math tells you SHOULD stop ricochets and inadvertent over the berm shots.

Heck maybe even a cheap plywood "High Wall" above the berm, to A: slow or deflect an errant round IF it happens, and/ or another piece of evidence that no bullet left the range over the berm..(ie no holes in the plywood)

Nope, nor likely does the Fire Marshal.

The ball is still in his court.

1: Do you know how many people involved in a conversation must be aware of or informed the conversation is being recorded?
2: Polite, discussion with the Fire Marshal, at a place of his choosing and time convenient. "Sir, thank you for your concern. As a law abiding citizen of the state of Texas, I too am concerned.. I very much wish to conduct myself and our family entertainment in a lawful manner. It would help if you would provide a cite for the Federal and or state law you have said we are in violation of?. I'm sure your correct, but we need to fully review the law itself, to ensure we conduct ourselves with in it. Thank you for your time...."

At the end of the conversation you will have a cite, or blabbering made to sound official, but meaning nothing.
3: Thank him again for his time... SHUT UP, no discussion, no arguing... just put your self in receive mode.
4: Go home and research the law he has cited (contact a lawyer),, or realize he has nothing,, and contact a lawyer to write a letter to the Fire marshal and the city / state attorney with your concerns.

Update: my dad went and talked with the fire marshal today in an hour meeting. Basically the fire marshal thinks we are a business and wants us to go through the hoopla that involves, $500k in insurance, engineering work,.... The Fire Marshal also said that we cannot have 20 people that at a time. Excuse me?! I thought this was America, where if a land owner can enjoy his freedoms and not have somebody making up laws/rules out of a whim.

So would the NRA be interested in helping, or even the 2nd Amendment foundation?

TITLE 1. GENERAL PROVISIONS

CHAPTER 1. DEFINITIONS AND OTHER GENERAL PROVISIONS

SUBCHAPTER A. DEFINITIONS AND PURPOSE
(5) "Business" means a trade, occupation, profession, or other commercial activity.
Do v trade anything with you for the privilege to shoot?
Is running a range your occupation, profession?
Do the people you invite over to shoot pay you in cash or credit for the privilege to shoot?

If you can answer no, it looks as if it is not a Business.. Perhaps ask the fire Marshal, to cite the law or code he believes makes what your doing a business? Or ask him to describe what he has observed you doing that in his opinion makes it a Business?

Seems the starting point is a polite discussion with the Fire Marshall, asking, you know for your edification.. What statute / law you were /are violating? What ordinance is he citing that you are in violation of?
