I was just now directed to this thread. I haven't been able to find the pics. If you still have them, can you, please, post the pics of how you were dressed and concealing on that day?

Thanks.

Thanks but according to my attorney false arrest is hard to prove. The NRA and other organizations have little or no interest in my case so I will not pursue this. Unfortunately this will happen again. If your gun is identified in Round Rock you will go to jail. The law states that the gun must be intentionally, recklessly or purposefully exposed to be in violation of the law but you won’t have time to educate the arresting officer. You will be cuffed and taken for a ride while the officers involved pat themselves on the back. :banghead:
So, do you know who ratted you out?
It just seems so strange.
Apparently I should be able to get a copy of the police report and 911 call. These are public records and all I have to do is file an Open Records Request for the items and legally they have to provide them . I have been busy making a living and have not done so. I will post it here when I get the results.
handog,
I don't know what's involved in an Open Records Request but If you have to make it in person or pick up the documents in person take a witness or better yet a lawyer with you to avoid any possibity of the type of treatment the guy in Carrollton said he received at the police station. i.e. Assault and intimidation. Or maybe get a button cam.
Actually Sergeant Goldman was quite courteous when I went to file a complaint. I have mailed my open records request and should hear back within 14 days.

Re: Cuffed and Stuffed

Lightningrocks, the common sense remark was aimed at the PD not you. Your posts have been well received. Reducing the barrel by 1/2 inch may not sound like much but in my case may make a huge difference. I appreciate your advice. :tiphat: As you said, if this were to happen again within two years the judge may see it as reckless rather than accidental.

The TSRA did respond to my e mail and my case is being evaluated, The NRA has not responded. I would like to bring awareness to this overreaction of the PD on behalf of all CHL holders. This is not about personal gain or having them pay my legal bills. I believe Williamson County has more CHL Permits holders than any other county in TX. There are a lot of us out there and I think it’s time to update the policies. An open carry law is a good idea. Most of us would still keep our guns concealed but would not have to worry about the gotcha mentality of some out there. :patriot:

I'm glad there were no long term repercussions for you.

I like my G26. I can carry full size G17 mags for spares. Best of all, I know I can hit my target with it. I tried out a bunch of pocket guns but I found them inaccurate except at very close range.

I carry anytime I leave the house. I'm using a Mitch Rosen tuckable IWB. Very low profile on the belt.

Carry On.

Thanks, I know the question of which gun to carry has probably been brought up here before. :deadhorse: And I know personal preference plays a role as well. I'll just have to take a trip to the gun store and see what feels right.

03Lightningrocks wrote:Again... I am not a lawyer and no expert on being arrested. I am just saying that this is how it worked in my case. Apparently it is how it is going to work in the OP's case also. What I learned from my case is that any time you use a gun for self defense, no matter how obvious it might be that you are justified, be prepared to get arrested and go to jail. The cops will tell you right quick that it is the judge and juries job to decide if your right or wrong.

Thinking about what happened to the OP, I have about come to the conclusion that the cops received a call about a guy with a gun. They responded in force. once they had put on such a huge show, they believed they had no choice but to arrest the OP until they could sort through the details of what happened. I don't think I have ever heard any stories about cops changing their mind once they decide your going to be arrested. Looking at it from their side, what if they had turned him loose and he went down the road and shot someone? Until they can figure out just exactly what is what, they have to take the safe way out. At the point of his arrest, they probably didn't know the details of why he had the gun and why anyone saw it. All they had was a report from a security guard stating that some guy was in the government building with a gun. I am not saying what they did was necessarily right, but neither was arresting me when I was defending myself. Hey, what you gonna do... the cops have to be sure they don't turn a feller loose that needs to be in jail. I have heard about others in self defense situations going to jail initially. Be prepared fellers. Your carrying a gun... cops take guns seriously.
I'm not disagreeing with you here that to the LEOs Gun = jail. They had their mind made up. Why should they spend a few minutes questioning me and the one who called it in? They don't have to spend any time in jail right. How about was he threatening anyone? Was the gun ever out of its holster? If I were going to murder someone why would I get a CHL.? Just sayin a little common sense would go a long way here.

Well, I’ve decided to carry something a little smaller. Perhaps a Kahr PM9.Glock 26. Any suggestions? I think that a new gun will really cheer me up and help me forget about this incident. :cheers2:

Can you expound on why you say this? Did I miss something regarding how you were spotted? (4 o'clock works better for me, too.)
I won't know for sure until I get the 911 and police record. Although I wear over sized t shirts they naturally are pulled up when I sit down. As I said, there was a rent a cop behind a one way mirror behind me. I was sitting in a fold out chair. I'm not sure if it was printing or that it was actually exposed for a moment. I prefere 4oclock myself.I just feel better at 3oclock knowing my shirt won’t ride up on the sides.

Re: Cuffed and Stuffed

There is a two year waiting period for a misdemeanor and ten years for a felony. In my case, after two years and $1000 I can have it expunged from record.

The PD returned my gun soon after the charges were dropped.

After spending a day in jail I feel more comfortable with my gun at 3oclock. At 4oclock I feel like it is exposed even though it isn't.
I was concerned before the incident, now I'm a bit paranoid.

Re: Cuffed and Stuffed

It's over. Here is what I have learned:

1. Keep concealed hand gun at 3 o'clock, not 4 o'clock.

2. Don't assume that the police will stand down after a perceived threat is over and you show them your CHL.

3. Don't assume the LEOs know CHL law.

4. Have a pre screened attorneys phone number on the fridge'.

5. Don't assume the NRA or the TSRA will be interested in your civil rights case or return your call.

6. Buy two similar hand guns. You will have one when they confiscate the other.

puma guy wrote:I ran across this thread last night and read all the posts. I thought about what I would do, complain or sue? I am not litigous by nature but filing a lawsuit may be the only way to get to the information I would be interested in. As I understand the facts this guy was reported to the police as having a weapon exposed and was pulled over by police (several based on the number of weapons trained on him). I don't know if being in a governmenr building has any bearing on the situation since he was confronted after he left in his vehicle. I would be interested in getting to the bottom of who and how he was reported. The poor treatment by police notwithstanding, they were reacting to a report and call from a dispatcher of an armed person it appears. There is no excuse for the treatment from and comments made by these LEO's. I would sue just to get the 911 tape in discovery to get to the bottom what how his CHG was "discovered". I have a concern that any one with a CHL could be set up with a phone call to police. Was this guy set up by someone? I don't advertise that I have a CHL but there can always be a slip from a friend or relative that falls on the wrong ears. I don't think filing a complaint will get to the bottom of this. If I found out who made the apparently false report I think I wold go after them. On a different note; A pilot nintentionally flew his plane into a building in Austin. I am contacting my Congressman to pass a bill to register all private planes..................Oh! Yeah! They are registered.
The waiting room in the Government building has a one way mirror with a security guard behind it. I noticed it when I went back to photograph the non 30.06 on the doors. My CHG was at 4 O'clock when it was discovered. I was sitting in a fold out chair and the Security guard had plenty of time to stare at my back where the CHG may have been printing. The rat theory has come up here before but I highly doubt it. I have found zero enthusiasm so far from the attorneys to work with me on a false arrest lawsuit however they suggest I contact the NRA and similar other organizations as well. Thank you all for your input.

"I don't think filing a complaint will get to the bottom of this." After my meeting with the sergent-'internal affairs I think your right.
