I'm glad you've done and continue to do your research. Please take every precaution necessary. I would love to know approximate number of attendee's... I might even drive from Houston to Austin to join!
Thank you. I don't have even a rough day set, since there are still some preparations I need to do.
SwimFan85 wrote:ifanyonecan you can. BUT DON'T DO IT PLEASE!

Every business in Austin will post signs prohibiting guns if you open carry.
I find this hard to believe. Besides, it's unlikely they'll post enforceable 30.06 signs. Lucky for CHL holders, business owners are generally ignorant on that matter.

I was supposed to meet with the lawyer tomorrow morning at 9:30, but because of the weather, UT Austin has decided to suspend most offices and classes until 10:00 tomorrow morning. I will call tomorrow to reschedule.

Do I have a background check and/or waiting period for buying a shotgun? Or can I walk in and walk out that day with it?
Woah, have you never bought a Firearm before?

Just like they will if they allow concealed carry right?

I would if I could friend, I've blown my Gun Budget for the next 6 months.

I encouraging the OP to do what he said he wanted to do, I'm just offering him advice on how to do it. Depending on my schedule, I might even go out and show support. As far as carrying a Long gun, let me ask my Lawyer "rlol". right now I am the only income earner in my household and seeing as I'm Eyeballs deep in Law School debt I dont think now is the time for me to risk being arrested.

If you want to jump out of a plane, feel free, I suggest you grab a parachute. I aint jumping I'm afraid of heights.
I know about the law school debt. You'll be joyous when its paid off. :cheers2:

If its the gun thing, I've spoken to my wife and her family about this subject before.

You can be hit with a civil suit for anything. Doesn't matter if you win the suit, you're still financially ruined. "Emotional Distress" certainly seems like a reasonable scenario.
Thats true. But there are also actionable claims here. I am just hoping the UT attorney sets him straight.

The situation will involve no arrests or unpleasant LEO encounters, since I'm going to make sure beforehand that it won't. The police will be aware of the whole situation, and if they tell me, "You can't do that, we'll arrest you," then I obviously won't go through with it. But if they know the law properly, they will send an officer to be there and monitor things, and everything will be fine and dandy.
whatever happens, send someone with a camera and camcorder to record what happens. I hope you prove the naysayers wrong and have the photos/video to prove it

No. But as Dadman used to say, there's right then there's dead right. This falls udner dead right.

*Disturbing peace
*Brandishing a weapon
up to some sort of felony if the police think they are in danger. He's not talking about walking around with a sign as part of a legal parade/protest. He's talking about wandering near downtown Austin right next to the school and the capital with a shotgun. Unless someone is completely unaware of current events thats er, not the smartest move to make in life.
If he Keeps the Weapon Over his Shoulder is that Brandishing?
You ever been to downtown Austin? I see people disturb the Peace all day long, I see Bums break the few pan handling laws, Rallys, protests ect happen there all the time with little to no Police interference.

I guess we can sit on our butts, or some of us can go out there and "Fight" for our "Rights"

Re: Open Shotgun Carry in Austin

frazzled wrote:You are on the internet asking real legal questions. This is "not prudent" as you are not consulting with bonafide criminal defense counsel versed in this topic. If you do this you will need criminal defense counsel, and a good bail bondsman. You are going to be arrested for, at minimum, some sort of disturbing the peace violation. Whether or not they can prove it is not relevant. You will be held and get to have the full fun of the jailhouse. Likely you will be arrested for several charges, because what you're expressing to do is not a bar fight, but significantly more.

Legal fees are not cheap. If they decide to make an example of you it will cost you several thousand dollars to defend yourself and get this pled down to misdemeanor stupidity. You're also explosing yourself to the chance the responding LEO's blow you away. After all, you're wandering around downtown Austin with a shotgun. Any conceptions you have about rights are all well and good, but its not going to go good for you because after all, you're wandering around downtown Austin with a shotgun. If you start espousing "your rights" post IRS building attack, you might viewed as less than sane and the thread level raised a further notch with commensurate actions on their part. Do you really want to be a party, the er receieving end of it anyway, of a situation gone bad and (later) justified shooting by the LEOs? To them you're a person wandering around downtown Austin with a shotgun.
Because of 9/11 we should give away all our Privacy, right? Because of Pearl harbor we should lock up Japanese people, right? Because one nut flew a plane into the IRS we should give up our legal right to WANDER AROUND OUTSIDE WITH A LONG GUN?

Look, friend, if you want to do this, do it, be nice, but you will more than likely end up in jail, face some headaches, might not be able to get a CHL, might get kicked out of school. I will commend you for the effort, but think about why you are doing this, is it worth the risk and do you want to be thrown on the ground my the cops?
