True about the DAs and judges. In some cities, especially big liberal cities like Austin, Houston, etc. they'll be happy to charge you with murder. Other places, they'll slap you on the back and say, "good shot!"

As far as the law, though, I'm not sure. Say you pull into your driveway and see a burglar coming out your front door carrying your TV. Can you do anything legally?
First depends if it is day or night.

Do you have that special insurance? If not, as cheap as TV's are that you can carry, the first call to an attorney would be more.

I will add another factor to your what if, what if your wife was at home, when you pulled into your driveway?

Interesting how you forget things. I got Pasadena, shot gun, 2 dead, but got went to trial totally wrong. He was no billed.

But yeah it was a big deal at the time.

Didn’t seem that long ago.

To me this hinges on the confrontation with the neighbor.

“He dropped the things he was stealing and came at me, I was in fear of my life”. If that was the case it would be helpful.

Back shot would not be helpful.

The neighbor may have also entered the house through the busted front door, when he was confronted by the burglar, that would be the best, since to me he was an agent of the homeowner.

Guy in Pasadena, who shot and killed two burglars next door, I don’t think had been give real specific and recently, watch my house request from the neighbor. He was semi acting on his own. DA made his life hell for two years. We also had a racial issue. Plus our Pasadena neighbor killed two. I don’t remember if they were front shot with a 12 gauge, but they were in the front yard.

Just a little after 5pm. So not nighttime. Neighbor called and asked him to check on his house, may have been alerted by alarm or cameras. Obviously that is helpful to the neighbor.

Burglar leaving with items. A confrontation, not sure what that means.

Neighbor shoots burglar, burglar arrested, expected to survive.

Neighbor not arrested at the scene.
