The intent of the CLEO sign off was intended to be an OK on the character of the applicant, NOT a way for the CLEO to state an opinion on the 2nd.

Shall Certify Legislation?

Kentucky and Kansas are passing Shall Certify laws for NFA items.

The NRA is pushing "Shall-Certify" NFA laws in several states. In Kentucky the law would give the CLEO 15 days to sign off on the NFA paperwork or issue a reason why they declined to sign the paperwork. If the CLEO does deny the paperwork the reason can be appealed in court and the court will decide if the person is prohibited or not. If the court decides the person is not a prohibited person they will order the CLEO to sign the paperwork.

This is an excellent idea since the BATFE is reviewing "changes" to NFA process and want to require a CLEO sign off even for trusts.

Do we have anything similar in the works for the next legislative session?
