The part about the rukus is disputed by several witnesses. Painting him as a drugged up maniac worked. According to medical experts hired by the family Eric had a bullet wound in his arm pit which would indicate he had his arm/s raised. Some witnesses said his arms never went below his shoulders. Two shots fired while he was standing and 5 shots when he was face down on the ground. His pistol was still in it's holster on the ground along with a cell phone. Of course his lawyers were prevented from cross examining the police or witnesses during the inquiry. They had to submit written questions prior to the inquiry. If you have read Mosher's (the guy who shot him first) testimony it's hilarious. All the things he said were going through his mind before he got there, the things he was thinking when he shot Erik. All totally contrived after the fact. He even said he knew the pistol could be fired while holstered because he had a holster exactly like Erik's. I read everything that was available at the time and the followup as well and I recall per witnesses the several cops on scene were giving Erik differing, simultaneous commands that he attempted to follow and at some point the cops commenced a circular firing squad with him in the middle as their target and then put a few more in him as he lay on the ground. Every time I look at this topic I'm reminded how easily this could happen to any one with a CHL. I do not mean to start this whole discussion again, but when you think about it here was a guy who broke no laws, just raised the ire an employee of Costco who make's a 911, being accosted by multiple PO with weapons drawn trying to obey their commands and winds up shot to pieces. Of course after the fact he was allegedly carrying a weapon not listed on his license, but that would have been unknown to any responders. It ways heavily on my mind how easily something like this happens.

Anyone know if any action (civil or otherwise) was taken against the guy who broke into Erik Scott's apartment and seized his property? I think he was a "Public Administrator" whatever that is. Was he included in the civil suit that has been dropped?

Pretty much says it. Mirrors my experience with friends, family - past and present. My aquaintences run from patrolmen to HPD Assistant Chief to a major city Chief, who gained national notoriety at one point. (not for anything corrupt) It was obvious who was on both ends of the bell curve. One is even in prison, though not for anything done while an officer. Like anyone else there are good ones and bad ones and most are right square in the middle doing their jobs and going about their business...just like every single profession in the world. Hats off to all who have worn a badge and tried to keep us loonies in line.

The qualified immunty reference peeked my interest. Apparently the same protection government and government official have legislated for themselves extends to police officers. I couldn't find a recent 9th District Ct ruling. The Trevon Cole settlement has happened. There have been 11 fatal shooting by LV Metro PD since Scott's and Cole's and the police union, sherriff and officers all say they will not participate in the new review process instigated after Erik Scott's one sided Coronor Review brought things to light. None of those shootings have been reviewed to date. The Police Union has a lawsuit to prevent the new process. The DA wants to have his office take over the reviews but, he just resigned to become the unions legal counsel. The Scott case is in discovery now and some watching the goings on in Las Vegas believe the Trevon Cole case settlement, which is the highest ever, has set the bar - no settlement - only an award. Of course that's if they win. At some point I keep thinking the taxpayers surely will get fed up with all the awards and settlements for the "justified" shootings in their fair city.baldeagle wrote:Wow! That's interesting. This is not directly related to the Erik Scott incident but this incident happened about the same time. The family of Trevon Cole filed suit in his fatal shooting during a SWAT led "drug" bust. The victim was unarmed and kneeling in his bathroom. Las Vegas Metro's Financial Affairs is voting on a $1.7 million settlement with the family. The suit was asking for $10 million. This shooting was also ruled to be justified.

I am disturbed that someone with the title of Public Administrator can execute a warrantless search with no cause that I can determine. I thought ongoing crime and probable cause were the only reason for that type search, but by police not some appointed or salaried administrator. Erik hadn't been charged with any crime immediately after the shooting. I wonder how quickly they were there because it raises a question in my mind as to the weapon found on Erik. I doubt EMT's and Paramedics are familiar enough with weapons to determine what pistol type and brand they found if called upon to testify, especially since their focus was on Erik. Is there any information available as to how quickly his body was removed? He was DRT according to posts and inquest, so why would he be moved by Paramedics anyway? I thought an ME had to visit the scene of a crime involving a fatality before anything can be touched.

It you read down it accuses Erik of criminal activity inside the store. Today in Nevada they held some sort of CCW forum and a Police detective from Las Vegas said that Erik Scott committed a felony by carrying a .380 that was only similar to the one he qualified on. Apparently you must carry the same model of gun you qualified with. Obviously another capital offense.

I don't know if a dead body can be charged with a felony or not but this is just stupid. They didn't even know he had the second gun until EMT's found it. If you follow his logic to charge after they're dead we can shoot before we actually know someone's breaking the law.

I was looking for information on the recent court ruling on Costco and Las Vegas and ran across yet another "justified" shooting in the Las Vegas area (Henderson). Same County. A 42 year old ice cream truck driver was shot and killed after her husband called her at to the scene of a traffic stop for his ice cream truck. Deshira Selimaj came and brought her two children. She was shot after police stated she pulled a knife and held it to the throat of one of her children. The Clark County Coronor's inquest ruled it justified as they have for every shooting but one since 1976. After filing a wrongful death suit the family received an out of court settlement of $700,000.
