Ahhh... OK. I was thinking if it was for refusing to kiss his royal highness behind it would be a real bad deal. Thanks for the info.

Re: TX: Dallas mom sentenced to week in jail for refusing to apologize to judge
I believe the judge said he would waive the jail term if she apologized for being selfish and admit she was wrong. But I think the Contempt charge was for violating the Temporary Restraining Order.03Lightningrocks wrote: ↑Thu May 07, 2020 8:10 pm
In addition, I would like to know if the contempt of court charge was because she refused to tell the court she was selfish and sorry for what she did.

Re: TX: Dallas mom sentenced to week in jail for refusing to apologize to judge
I believe you are correct that it was Contempt of Court for Violating the Temporary Restraining Order. But per my post above from her attorney: Court failed to post a bond indemnifying her against lost income as a result of temporary restraining order. No bond, no TRO. No TRO, no contempt.TreyHouston wrote: ↑Thu May 07, 2020 8:07 pm Can someone explain this to me? From what I understand she was sent to jail for contempt of court. The judge did not rule on her case. The Texas Supreme Court stepped in and ordered an immediate release from jail pending acceptance of her case.
How can the Texas Supreme Court debate taking her case if the case hadn’t been ruled on. Can another court overrule a contempt of court? This is very confusing
So once the first domino fell (no bond indemnifying her), everything else is moot. I heard her attorney on Tucker Carlson state he had filed a writ of Habeas Corpus which I believe is for unlawful detention or imprisonment, which the Supreme Court granted. But I'll let the lawyers weigh in and see if what her attorney said is correct.

Mark Davis of 660 AM here in Dallas posted the following statement on Twitter from her attorney Warren Norred. Twitter is not letting me copy the link to Mark's feed (emphasis mine):
Atty #WarrenNorred on #HabeasCorpus writ that sprung #ShelleyLuther: "She's in contempt of a temporary restraining order. TRO generally has to have a bond. If you want to tell somebody they can't work you have to put up a bond for the amount of money that you are denying them."
#ShelleyLuther attorney #WarrenNorred on the #HabeasCorpus ruling that sprung her: Court failed to post a bond indemnifying her against lost income as a result of temporary restraining order. No bond, no TRO. No TRO, no contempt. Quotes to follow. #FreeShelleyLuther

Right now it appears that I can survive without PPP funds and I don't like the thought of taking "welfare" - but here's the problem with that: If they give it to some businesses, the only fair thing is to give it to all which qualify equally under the rules they specified, or else they create a competitive advantage for a few at the expense of the rest. The most important thing is that the playing field be level, and it isn't level - not even remotely.
It's not welfare when the government orders you to close. What chaps me about all this, is it puts taxpayers on the hook to pay for all this and yet the small businesses and individuals that need the assistance the most are not getting it. This should be considered a form of Eminent Domain. If the government (local, state or fed) took your property and put you out of business they have to "fairly" compensate you for the value of the property to do so. They would also have to go through a judicial process. This is orders to stop doing your business if the government doesn't deem you as "essential".

So my comment to have Gov Abbott pardon her immediately apparently cannot happen. The Board of Pardons and Paroles must approve a pardon. But I say get the wheels moving on this.

I too applaud what she has done - very brave person who is trying to survive.RPBrown wrote: ↑Wed May 06, 2020 12:12 pm Although I agree with everything that has been said here, and I applaud her efforts, she knew what was going to happen to her. If she was truly opening to feed her kids, she will have a hard time doing so in jail. Seems she would have been a lot better off just doing what he asked and waiting 4 more days to reopen. As for her employees, they could file unemployment. Or, why didn't she file for the PPP loan to pay her employees through this? Then, after she reopens, put up a campaign to elect someone else in place of the judge. The way she tore up the order so defiantly, seems she was just looking for her 15 minutes of fame
In this economy I will do what I have to do to feed my kids and actually am. Daughter and SIL both laid off so we bought them groceries to last a couple of weeks.
Gov. Abbott announced the new earlier date of openings for salons and barbershops during or just after her sentencing - no way she knew that it was going to be opened up sooner than previously announced.
Per previous news reports she said she paid her business rent this month instead of her home mortgage so she wouldn't lose her business where she has multiple stylists who work there who also would be out of business. It wasn't just her that was impacted by not being able to work and feed their families and put a roof over their heads.
My understanding is that she did file for PPP loan - but as we know the funds ran out and a lot of small businesses were left with no options. Also I personally know people who have been desperately trying to file for unemployment but cannot get through to even file for it.
This is a travesty of justice and Gov. Abbott should pardon her immediatedly!
