I know people keep saying that he had no business bringing a rifle to a protest and no duty or right to be protecting another person's business. Especially with a rifle. I do have a different opinion or viewpoint.

He did not go to a protest with a rifle. The protest came to him.

Remember back when there was this thought about the prosecutor intentionally going for a mistrial? The result of that could've been a mistrial with prejudice that would prevent any retrial due to double jeopardy because of intentionally throwing this one. I gotta say that this also smacks of being intentional, but with the hopes of being discovered after the jury has begun deliberation to avoid that mistrial with prejudice thing. Unless that is still on the table?

And IIRC, there is a mistrial with prejudice for that reason double jeopardy kicks in and they cannot retry him.

Why would there be? KR did **NOT** "straw purchase" a firearm; The person who completed the sale did. But did he really? A straw purchase occurs when one person buys a gun for someone else who is either prohibited by law from possessing a gun or who does not want his or her name associated with the transaction.

So who is a prohibited person?

This group includes anyone who:
  • is a felon
  • has been convicted of any crime punishable by more than a year in prison (whether or not they were ever sentenced to or served a day in prison)
  • is under indictment for any crime punishable by more than a year in prison
  • is a fugitive
  • is an unlawful user of any controlled substance
  • has been adjudicated as a mental defective
  • has been committed to a mental institution
  • is an illegal alien
  • has a dishonorable discharge from the military
  • has renounced their U.S. citizenship
  • is the subject of a restraining order restraining the person from harassing, stalking, or threatening an intimate partner or the child of an intimate partner, or
  • who has been convicted of a misdemeanor crime of domestic violence
The US military routinely takes 17 year olds and provides them with firearms. So just being 17 years old, at least under federal law, does not seem to make one a prohibited person.
I don't think it needs to be a prohibited person. There was that officer back east that purchased a handgun for his dad at his LEO discount. His dad was not a prohibited person, but also not LE to be eligible for the discount. One or both or them now have criminal records and might have done jail time.

Yeah, I'm sure she would, but didn't we do the same thing with the whole ACA is a tax ruling even though the government lawyer argued it wasn't a tax? I still think Roberts was wrong on that one.
The ACA is a tax ruling was the final arbiter and affected the entirety of the U.S. population. This, whatever the ruling, no so much.
The number of people affected isn't really what I was talking about, however, a ruling against Kyle now or in the future in appeals courts if it ever gets to that level could affect many. Not the entire country, but still many. I was only observing that people on both sides of an opinion tend to say a court got something wrong when they disagree with a ruling. Sometimes the people are right and sometimes they are wrong.
Everyone has affordable health insurance now right?

I have never understood the logic that running away from a confrontation makes you the aggressor. Leave the area. His next point, was if you have to shoot, you,your loved one, etc. have to be in imminent harm.

Because of the political crisis in this country, the moral compass is gone. What was right, is now wrong and vice versa. People that were never slaves demand reparations from people that never owned slaves. Defunding the police will make us safer. The Anti-facists use the violent tactics they attribute to conservatives and Trump supporters, but you never see violent masses of conservatives protesting, looting, and rioting. If race relations are so bad as the media makes our country out to be, then how come my black neighbors and colleagues and I get along so well? How did we end up in this Twilight Zone?
There are some (maybe many) on the left that think Kyle should have let himself be attacked. These same fools think that the police should not be able to use deadly force if they are being attacked by a minority. Twilight Zone or Bizarro World, take your pick.

His other mistake was that he could not legally carry a rifle either. In Wisconsin, it is illegal for a minor to be in possession of any loaded weapon.
This has been my biggest concern since we found out who he was.
