Only $40 was stolen through fraud. Not the vehicle. The shooter went to the vehicle to retrieve the gun then shot someone running away that was no threat.
Dude’s going away for this one. I can’t see how he could get out of a murder conviction, but then I never thought that Army guy driving an Uber would be convicted either, so who knows?
