There is really no 'statute of limitations' on 30.06, however, the law states that it only applies to license holders. So at the time, it would not apply to him. Also, Verbal notice is hard to prove. Especially if it is just his word against someone else's. If there were other people present, then it becomes a little more tricky. Also, 30.06 has the requirement that verbal notice has to be from someone with the authority to make that decision. If it was his manager, and not someone who has actual control of the building, then it could be argued that he was just reciting policy, and did not have the actual authority to do anything.C-dub wrote:Okay. Sad as it is, I am sure there are people out there that, if they saw you slowly pull a gun out of the robber's view in preparation to use it, would alert the robbers that you are armed, in an attempt to get 'cred' with them, and save their own behind.
There are a lot of backstabbing individuals out there that would gladly step on someone else's face if it could mean their safety in a situation like this. If you were going to draw, in preparation to possibly use it, make sure you do it outside EVERYONE's view, not just the robbers' (minus immediate family, of course)

It looks like a no win situation if one were to try and stop them. However, if it looked like me or my family were going to get it anyway I would have to try. This is just such an unbelievable scenario that it's almost beyond comprehension.
And this is why we need MORE people in Texas with CHL's.
Imagine if they started shooting people, and suddenly, 6 or 8 restaurant patrons pulled out handguns and started returning fire.
Definitely a better scenario.
Even a Husband/Wife combo makes the odds 100% better.
