These type forfeiture laws are something the Nazis would have loved. It is a law ripe for abuse - and it does get abused. It is confiscation of property without due process. If the person is convicted of a crime and the assets tie to it, then perhaps it is a viable law, but under this law as it is, no arrest, prosecution or conviction is necessary to confiscate the property. Does this sound like what the founding fathers had in mind or the sort of thing King George had in mind?

Imagine, if you will, that your place of employment transferred you to another city hundreds of miles away. You don't want to sell the house you are leaving which is worth $200K, and is paid off, because the housing market is depressed, so you decided to rent it out until the market is better. The renter decides to make meth in the garage or grow weed in the back yard - unknown to you. The police find it and guess what.........

Now you can appeal this confiscation, but under present law you have to put up one third the value of the property as a sort of bond. You don't happen to have $60K laying around in cash so you can't protest or challenge it. BTW, if you did show up with $60K cash, they could just claim that was drug money and take that too.
