I fear that the NDN will face a civil suit for numerous reasons, including intentional harm, medical bills, support for his family during his recovery etc.
You left out the unsafe deck with no railing.
I think the defender is in a pretty good legal position in view of the fact that he fired only once and inflicted a non-life threatening wound, then barricaded his family against the defender to eliminate the need to inflict further damage. Under the reported circumstances he would have been well justified in firing until the threat was more definitively ended.
