Maybe even a bigger idiot. As a trained security guard he should know that he was not an extension of the DEA.jmra wrote:Then he would still be an idiot.nightmare wrote:What if he was a security guard in uniform, washing his car on the way home from work, and did the same?WildBill wrote:In the OP, if Trujillo told the guy in the carwash, let me see those pill bottles, that would be directing that person to do something that an LEO would do. If a guy has a badge around his neck, even if it says CHL, I could see a conviction. Of course we don't know all of the story.

Yeah... I agree. He will walk. His misguided attempt at playing DEA agent is going to cost him a few dollars for legal expenses but he will beat the rap. JMHO based on what I have read so far in the news on the story.WildBill wrote:It seems to me that the only witness to testify that Trujillo was impersonating a public servant would be the other person at the carwash who allegedly showed Trujillo his prescription bottles and tried to hide them. If he has a good lawyer, I think he will beat it.rotor wrote:I agree but apparently intoxication was not listed as part of the arrest. If the alcohol was not listed and no forensics done what do they have, a guy with a dumb badge around his neck, a gun in his pocket (legal for a chl) and the question of impersonating a leo. Seems to me that if the badge said "CHL holder" than he was not impersonating a "public servant". This will probably cost him a lot of money but from my limited legal experience I can't believe he will be convicted.

Isn't that the truth. This does not look like a situation where he was saving a person in distress. He was trying to be a narcotics investigator. He may walk but I bet he will be paying serious cash for the pleasure. Legal expenses add up quick for a criminal defense attorney.tomtexan wrote:Had he lived by the "don't start none and there won't be none" philosophy, he wouldn't be in the situation he is in now. But, he just couldn't mind his own business.jmra wrote:Unless you witness an action that puts lives in immediate danger, the best thing to do is be a good witness and keep your distance. Then again. Why on earth was he taking it upon himself to play detective with a fellow citizen on the street? He is lucky it wasn't someone like me. I would have told him to go pound wood. If that was not good enough for him, he would have had a real problem on his hands.
