On stages that require "gun loaded to division capacity", you MUST load up to that capacity if your gun/mags will hold it. For example if you were shooting a Glock 17 in ESP or SSP you would be required to start with mag loaded to 10 rounds and have one round in the chamber. I have failed to do this a few times and earned the penalty
