There is some difference of opinion on that one around these parts. The majority feel that you read the law the way it is written and that 30.06 cannot be enforced if a property is owned by a governmental agency. And that 30.06 cannot be enforced if a property is leased by a governmental agency. Either one is enough to render a 30.06 sign unenforceable.

Furthermore, speaking on principle...
If a corporation is going to rake in huge profits using tax money to build the facility in which they operate, they deserve no special rights. That stadium is public property. If they want to restrict carry under the law, they ought to pony up their own dough instead of riding on the backs of taxpayers while whipping them at the same time. They cannot have their cake and eat it too. At least that's how I see it.
Except for the fact that, aside from the land, The Hobby Center was built with private donations raised by Houston Music Hall Foundations.

In a condominium, each unit owner owns an undivided interest in the underlying land and common areas.

Permanent improvements to real property belong to the landowner. You cannot own a building that sits on leased land. As you said however, you can own movable personal property such as a construction trailer, but the Hobby Center is one big building!

So you're saying you cannot 'own' a building or portion of a building on property that you do not also own?

Actually, Hobby Center is two large buildings and a parking garage. I don't know what you can or cannot do regarding real property. I'm simply telling you what one of the directors told me.

I got clarification on this. HMHF owns the facility. The land is owned by City of Houston and HMHF holds a 30 year lease.

I'm not a real estate attorney, but I don't think that's legally possible. Whoever owns the dirt owns the improvements.

Now the city could donate the use of the land and the Center can pay to build on the land they are using, but the city still owns the land and the improvements.

Not sure what to tell you. My guess is they entered into some sort of a lease agreement with the city. It is not uncommon for municipalities to enter into 99 year, $1 per year type leases with non-profit organizations. If that's the case, it is possible for them to own the leasehold improvements. Either way, I'd be curious to know if there's a distinction between the ownership of the real estate and the buildings.

Let's say, for instance, you are building on city property and place one of your construction trailers on the site. Since you own the trailer, could you post a 30.06 even though the land on which it sits is city propery?

I just spoke with one of the executives of Hobby Center for the Performing Arts. The City of Houston owns title to the land only. Houston Music Hall Foundation built and owns the facility. They have an arrangement with the city whereby the land was 'donated', but the city retains ownership.

I wonder how that works with regards to PC 30.06.

Wortham Center is city owned. Hobby Center is owned by Houston Music Hall Foundation.

The Hobby Center Sarofim Hall has the correct one inch letters on the front doors, but arguably once again white letters on clear/slightly tinted glass is not contrasting. The signs are at the bottom of the doors and really are not in a conspicuous place. They could be easily missed if one is paying attention to ones date as Mrs. Anygun looked quite attractive last night in her evening attire. Needless to say I did not take the time to check for spelling. She has that effect on me.

There was no pistol buster graphic, just the text.

If you are allowed in the stage entrance you will never see the 30.06 but a sherrif deputy will let you in.

I have a keycard, so it's not a problem. However, there is a door to the stairwell of the admin building that's usually open when the theatre is open. If you go up to the 2nd floor, you can walk across to the main lobby. There is no posting.

Hobby Center has apparently compliant 30.06 posted on the front doors. Wortham Center does not. Not sure about the Alley or Jones Hall.
