All the more resason to NOT chase down a bugular and try to hold them at gunpoint in your open yard at 2AM. Will BG #2 in the pickup drive down the block, stop, take cover and start shooting?
Will BG #2 take a neighbor hostage and try to trade him for his accomplice?
Until BG #2 stops moving, he is a threat in the night time and a mortal danger to me and others.

You updated the post with the second story after I posted. So, IMO the homeowner is more than likely gonna be charged if he shot at someone who was not a threat.

Cant' tell if the guy in the truck or yard tried to get away (assuming yard.) However, if this is actually how it went down it may not play out well for the homeowner.Investigators say that's when another man drove up to the house. When he saw the homeowner had a gun, he tried to get away, but the homeowner fired, and hit the man in the head.
