Actually it is both the adult and child. Adults would normally be charged with providing the alcohol and a minor would be charged with minor in possession. Those cases were usually a parent poviding alcohol for a party their child was throwing and the parents were then not present AND there were others there at the party underage and drinking.JP171 wrote:word of caution, be careful about giving your children any alcoholic beverage, remember it says affirmative defense, but it also doesn't rule out the family code about injury to a child. If you are stupid enough to give your kids enough alcohol to get them drunk, even if u are present, then IMO CPS needs to get involved.

Actually, minors can drink in Texas if the are with their parent, adult legal guardian or adult spouse.Lambda Force wrote:Where is that in the law? Big Shot's Sports Cafe in Bedford shows to be Blue on the TABC website but they post a 51%. I called the manager to ask why the 51% sign when the TABC site states they should be Blue and he contends they are defiantly 51% and the TABC gave them the 51% sign.
TABC say they are 51% and when they renew their license it will reflect it at that time. Not sure if the person I called at TABC had a clue on what they were talking aboutand couldn’t explain why they show them to have a Blue sign????
One of two things is possible:
either their current license was less than 51% and they recently got audited and found to be more than 51%, so they are changing their license
-or-
The database has an error.
The one to way to tell now is to go look at their current license on the wall now. If it says SIGN=RED, then they are 51%. If is says SIGN=BLUE, then they aren't. The license posted is the one that is supposed to be valid and in effect.
