The 16-year-old was in front of Judge Carmen Kelsey Wednesday for a detention hearing. The boy's mother, Rosalinda Ponce, told us she's torn between her husband and her son, but says her children come first. She appeared in court next to her son hoping he would be released from detention.

However, fearing he was a threat to himself and others, the judge ordered the teenager back into custody. So far no charges have been filed and investigators say there may not be.


So, he's definitely being held in detention. If the judge feels he's a threat to himself, then he should be in a secure psychiatric facility for a mental health evaluation. And the last time I checked, we don't lock people in jail on a judge's orders just because she feels someone might be a threat to others.

Police say it appears to be self defense. Prosecutors say no charges have been filed against the boy, and none are likely.

But he's still in jail, just because the judge thinks he ought to be???
