I stand corrected. So it sounds like they are the exact same standard, then. That makes things easier.ScottDLS wrote:The definition of intoxicated for carrying includes the 0.08 BAC, just like for DWI, because they both rely on the definition in TXPC 49.01...

Re: KHOU - New bill against carrying firearms while intoxicated
The term "intoxicated" has the same definition for both driving and carrying a firearm. For driving there is an additional presumption that you are intoxicated if your BAC is above a certain level, so theoretically you could be intoxicated for purposes of getting a DUI, but not intoxicated for purposes of carrying a gun. But, by definition you must at least be too intoxicated to drive if you are too intoxicated to legally carry a gun.SMRoot wrote:Maybe I have been misinformed, but I thought that many folks on this site were of the opinion that an officer could and would arrest you if you had ANY alcohol in your system. The theory was that even one drink removed the normal use of your faculties. Is that just baseless paranoia talking?
As far as "many people's opinions" I should also add that by getting out of bed in the morning you run the risk of "taking a ride" and "not beating the ride" and a bunch of other terrible things that have to do with being transported somewhere.

I don't like clouds. Can we ban them too?Syntyr wrote:TreyHouston wrote:Knowing the left.. they might think this NEW idea is a good one!bblhd672 wrote:Feel good legislation.
The US should just ban alcohol...
No you are looking at this wrong. Alcohol is TOTALLY safe and never has hurt a soul or caused any accidents or mayhem. Now guns on the other hand are evil incarnate. Ergo the solution is to BAN GUNS!

Re: KHOU - New bill against carrying firearms while intoxicated
I believe that it is already illegal to carry while intoxicated. So either this bill is just a feel good measure that does nothing, or they are defining "carrying" in a different manner.
If this extends to ones home, and "carrying" includes having access to a gun that is in a safe, then this would have the practical effect of making one choose between alcohol and gun ownership. Kind of like extending "drunk driving" to include being at home with keys to your car that is sitting in the garage. I hope it doesn't go down that path.
My personal rule is that the gun goes in the safe before I get a third drink in my hand for the night.
