The amount of a settlement that a person gets depends on many factors. When someone is killed, and their heirs sue, the future earning capacity of the deceased is one of the factors that is used to determine the amount of a settlement. Whether or not the heirs will agree to the proposal depends on the financial situation of the heirs and how much or how little they will settle. For some people a lump sum of $100,000 is a lot of money. More than they would ever see in their lifetime. For others, that amount as a proposed settlement would be considered an insult.
