Thanks for the link Dan.Texas Dan Mosby wrote:Here's a decent article: http://www.nytimes.com/2007/02/14/us/14military.html" onclick="window.open(this.href);return false; In reply but starting to go OT.. What is a "moral waiver" you speak of? Approved by who? When?
Psych cases, patterns of criminal conduct, all waived at enlistment for convenience.
I've had a few of these losers, and had to fight tooth and nail to get rid of them, despite the fact that they should have never been in uniform in the first place.

Re: Las Vegas: Former MP charged with murder, robbery
There is so evidence of the suspect being let into the service on a waiver or whether she had a criminal record prior to joining, what kind of discharge she had, or whether or not she was a high school graduate.

Re: Las Vegas: Former MP charged with murder, robbery
Getting more OT, but the novella begun around 1886 by author Herman Melville, "Billy Budd" is such a story. It was made into an excellent film in 1962.seamusTX wrote:Going back another century or so, armies and navies took convicts out of prison and "impressed" (that is, kidnapped) idlers and neer-do-wells. Those were the days when sheer numbers could still win battles. Flogging was a standard punishment for disobedience or insubordination. - Jim

Re: Las Vegas: Former MP charged with murder, robbery
This explains the charge of "murder with a deadly weapon". It can reduce the discretion of a judge when determining prison sentences.
http://www.nevadaappeal.com/article/200 ... /102010079" onclick="window.open(this.href);return false;Nevada Chief Justice Bob Rose told the legislative committee studying Nevada's sentencing, that mandatory minimums are especially harsh when combined with the deadly weapon rule which, in Nevada, doubles the minimum sentence for a crime.
"The deadly weapon enhancement has resulted in many many very long sentences in Nevada," he said.
"What I do object to are mandatory minimum sentences that, in some cases, prevent a district judge from tailoring a sentence to fit the offense and the broadly defined deadly weapon enhancement that doubles an already stiff sentence in most serious crimes," he said. "The end result is that we see many very, very long sentences assessed, but with no mechanism to review them.
"In my judgment, this prevents the state from making the punishment fit the crime."

Re: Las Vegas: Former MP charged with murder, robbery
I am guessing, but it probably carries a higher penalty or maybe a special circumstance that makes it easier to get the death penalty.seamusTX wrote:Not to make light of this tragedy, but is murder with a deadly weapon worse than murder with bare hands or poison? - Jimmurder with use of a deadly weapon

Re: Las Vegas: Former MP charged with murder, robbery
Autumn Dawn Murry, 21, who was arrested earlier this month in connection with the shooting death of a cabdriver Tesfaye Arze, was indicted by a Clark County grand jury on counts of burglary while in possession of a deadly weapon, carrying a concealed weapon, murder with use of a deadly weapon and two counts of robbery with use of a deadly weapon.
It appears that this lady is also a suspect in a convenience story robbery that occurred about an hour before the cabdriver, Arze, was shot and killed. Police are looking for, another woman, Felicia Mosely, 18, who was seen getting into Arze's cab with Murry, has been named a person of interest in the case.
