So, the lawsuit was "dropped." But, I have questions. Was a monetary settlement paid by any party ( I understand the good samaritan could not afford to pay anything) in return for dropping the lawsuit? Often confidential settlements are reached in return for dismissal of the suit. Would hate to see a dime paid out on this one.

"Reasonable means necessary" language usually involves a determination by a jury. But, again, I have no knowledge of how they would resolve those issues under Indiana law. Having to try that case would be very costly.
I hope her lawyer can figure out a way to get it dismissed on summary judgment so as to avoid a trial.

Have no idea what Indiana law says about any of this. Would be interested in the comparative responsibility statute of that state and other issues.
Difficult to believe that case will get very far.
