First off, I have serious doubts that a case like that would make it to the trial stage in Texas (anyone, please feel free to cite a case like this, and I'll redact the statement). I would also countersue for wrongful prosecution, and whatever else I could slap on them - before anyone talks about frivolous lawsuits, wouldn't theirs already be frivolous?
