I think the correct analysis of basic rights is that they are rights of man, speaking without gender bias. "Man," as in all of us.
What doesn't apply to non-citizens is the American pledge to protect rights like the 2nd.
I don't think I'm hair-splitting. I think the difference between a granted right and an oath to protect and defend established Constitutional guarantees is important.
