Yes, it was me and not flint that proposed this.

And I realize that in practical terms it is not a big issue where people are getting hassled at the present time.

At my place, I too have a firing range, and it is perfectly legal for me to have guests come over and engage in target practice. It falls under the "sporting activity" exemption.

But I made the proposal as a non-controversial way of "clarifying" the legality of a very common activity while simultaneously getting OC on the table during the next legislative session.

University carry by CHLs is much more important and significant. But as a consequence it will be a much bigger battle to fight. (Also, one well worth fighting.)

Nice summary of the reality of OC in the various states where it enjoys differing "technical" degrees of legality.

I'm surprised that there has been so little reaction to my proposal to allow for OC in TX on private property with the owner/occupant's consent. This modest advancement should be relatively non-controversial, and in line with TX's traditionally strong private property laws. And mostly, it would just serve to clarify the law for situations that come up every day.

For example, My wife and I were houseguests attending a small gathering at a friend's house last year. The subject of CHL's came up and my wife mentioned that I had one. My wife's friend asked me if I had a gun with me all evening and of course I said "Yes." She was quite surprised and asked me where it was and could she see it. So I raised my untucked shirt and showed her where my IWB holster was positioned (around 3 o'clock). At her request, I drew the small revolver (SP101), cleared it and handed it to her so she could get a feel of what it would be like if she elected to get a CHL of her own.

Technically, I think I may have violated the "willful failure to conceal" statute, though maybe not as I was acting in my capacity of an NRA Certified Instructor and providing basic safety instruction to this person in addition to advice on concealed carry. But IANAL, and for all I know I could have been in violation.

I must admit that I wasn't really concerned about it because other guests present were police officers who never batted an eyelash at any of this. FWIW, I had previously donated my services to teach the NRA Basic Pistol Course to the PD's associated Explorer Troop, so I was well known to the officers present.

At any rate, my non-controversial proposal would fully legalize situations like this while getting the camel's nose into the tent for further gains down the road. I think that the TSRA should consider bringing it up next session.

It's an interesting idea.

With (1) do you mean explicit consent? If the owner of a public accommodation wanted to allow open carry, would they have to post a sign saying that it was allowed, or give oral permission?

Some police agencies would object to (2) on the basis that it would promote weapons display in traffic altercations. I don't make this objection, but the official police point of view has a lot of weight with the legislature.

First off, I realize that one thing I didn't mention in my original proposal is that it would only apply to people who have a CHL.

I was thinking more along the lines of implicit consent. i.e. you're there, you're carrying, and no one's complaining. What I had in mind was "private" provate property, not necessarily public accommodations. For public accommodations, I would say they would have to post some kind of sign, while recognizing that few would do so.

With regard to 2/3, I would point to the (mostly trouble-free) experiences of other (OC) states. That, combined with the vast experience here in TX since 1996 showing CHL's to be "certified good guys" who pose no threat whatsoever to LEO's, should take care of any objections. Another point is that we now allow for concealed carry in vehicles without a license. So open carry by CHL's should be no problem.

And LEO objections might face a bit of an uphill climb. In 1995, they were putting out dire warnings of blood in the streets if we allowed for CHL's. Later on, a number of them, to their credit, were big enough to publicly admit that they had been wrong.

In my own mind, I think that someone putting on a leather vest or something as they leave their car might just have a salutory effect on some big mouth troublemaker who just might have forced him off the side of the road or something, whether he glimpses the gun or not.

And my proposed law would not do anything to change the legal circumstances related to drawing the weapon.

My whole idea is to come up with something that is easy to get passed. Limiting OC to private property with consent does away with the situation where Mr. & Mrs. Soccerpeople unexpectedly encounter people who are OCing. This would also help to keep the bill low profile, and give the media very little to scare people with.

Now, down the road...... What is it they say about the camel's nose?

Here's something I haven't seen proposed before.

How about a bill that would allow open carry:

1) On private property with the consent of any lawful occupant of said property. (This would not include common areas of apartments or condos, unless the apartment building's owner or the condo association specifically allowed it.)

2) In a motor vehicle under your control or with the consent of the person who is in control.

3) When entering or leaving such a vehicle. (Not sure of how I would word this legally. My intent is to provide for people to be able to don and doff cover garments when leaving and entering.)

This would allow for OC when at a friend's house or spread. Of couse in practice this is done every day without issues, but my proposed law would make it fully legal.

It would also make it convenient for people to be comfortable in their cars while at the same time to not worry about willful failure to conceal when covering or uncovering.

At the same time, since it just affects private property with the owner/occupant's consent, it should be pretty non-controversial.

Maybe it would help our camel get his nose into the tent.

If I start with whatever assumptions I want, I can reason to any conclusions I want.

I have no problem with having the option of open carry. But for my own part, I wouldn't use that option too often.

I OC on my little spread, mostly "because I can." But out on the street, I am more comfortable with the element of tactical surprise on my side.

OC is much more accepted in rural areas, and especially out in the fields. Not so much in urban areas. And by definition, that's where most of the people live.

What I'm getting at is that anything that would "condition" society in that direction would probably be a bunch of things that would be very unpleasant for everyone.

Like I said, it's not gonna happen because millions of Texans are suddenly convinced to start loving guns more than they already do, because we talked them into it or something. "Society under seige", or something like it, is what it would take. And none of us would want to see that.

The simple fact is that while people used to be comfortable with OC 150 years ago, those people are long gone.

The overwhelming majority of the general public today is not comfortable with OC, and they are not about to change their views any time soon. In my view, it would take some kind of massive societal upheaval for that to take place - something like our society being under a continual state of seige by terrorists or something like that.

But here and now, living in relative peace and tranquility, there is simply no impetus for it. Right now, TX is a pretty comfortable place. For that matter, America is a pretty comfortable place. When people are comfortable, they tend not to make big changes.

In my experience, "smart and stupid" show little or no correlation with someone knowing the difference between "right and wrong."

While many criminals, especially those prone to criminal violence, may be stupid, it's usually not because they don't know the difference between right and wrong. It's more often because they simply don't care.
