I forget where I saw it but one vlawgs I have been watching covered this. Essentially KR can sue, but his damages are very limited due to the damage the trial has done to his character.

The problem is the jury is from Kenosha where the majority of people think he's guilty just because he was there and the media told them so. The defense has worked very hard to snatch defeat from the jaws of victory on this one, they didn't even comfort or talk to Rittenhouse when he came off the witness stand.

Rittenhouse did say that if Rosenbaum got his gun then he was certain he would have been killed by the deceased. He didn't use the phrase, but he did say as much.

This is a prosecutor that will be remembered for either a miraculous victory because of a biased jury or as an absolute failure. No prosecutor should ever put themselves in a position where the judge gets that angry with them, in fact no attorney should ever do that!

While the court is in recess for lunch let me just say that after the cross examination the Jury can't help but question every aspect of the prosecution since they were depending on this witness. The body language of the prosecution, especially stay-puff's multiple face palms, only cements my belief that the defense has already won most of this case as long as the jury isn't blatantly biased.

I just watched the defense impeach the prosecution witness Grosskreutz, who was shot in his arm, with their first question in less than thirty seconds. Then it goes downhill for the prosecution from there. Looks like the witness may have just scuttled his civil lawsuit too during the defense cross-examination.

I watched one of that guy's videos for the first time yesterday. He makes a lot of sense.
Tonight's live stream "Sidebar with Greg Hartley! Viva & Barnes LIVE" has some discussion on the Rittenhouse case, including that the prosecution played videos that had been originally live streamed with prejudicial comments shown (and possibly computer spoken), then they move on to the actual topics they wanted to discuss.

It seems that there has been a little bit of a shakeup on the defense legal team, the Viva Frei youtube livestream from 11/1/21 has more details from Robert Barnes who is no longer on the team.

Robert Barnes, who is a part of Rittenhouse's defense team, cohosts a weekly live stream (Sundays) on the youtube channel Viva Frei. As I understand it Barnes role is more to handle PR and advise, so you can often get an idea of how the defense is reacting to things from the Viva Frei channel. Although I also suspect that he may feed disinformation as well. His various statements and reactions to the state's behaviour regarding the use of force expert witnesses is interesting.
