Two things come to my mind. First is that he is in full election mode and is not going to rock the boat, possible but not really his style. Any lawsuit filed against Travis County would most likely be done under the Texas Preemption law that prohibits the city from regulating firearms. This would be a clear violation as they are regulating the sale of firearms on county property.

According to Fox News the Austin American-Statesman has reported that Travis County commissioners have decided not to renew the lease for the Saxet Gun Show and that County commissioner Biscoe expects lawsuits over the issue.
